Please can someone give me some advice

I posted a thread here a while back with regard to some catalogue debts that had been run up in my name by my ex partner. After speaking to trading standards, I wrote to the debt company's asking them for a copy of the supposed credit agreements. They wrote back stating that they had no copy of the agreement and therefore would not be dealing with the case any longer as they had no proof it was mine. This was a good month or so ago. Now, yesterday I received a letter from them stating that they are taking me to court for the same thing. I was under the impression from trading standards that they are not allowed to harrass you like this when there is a dispute (which there is). Please can someone help???? Should I send them another letter or just ignore them?? If so what should I put in the letter - I am really at my wits end with this.

I also had the same problem with an ex running up debts on my account :mad: & although the DCA were very sympathetic & realised that there was a limit to how many pairs of size 10 mens trainers & car stereos that I could have needed :rolleyes:, as the account was actually in my name I was liable. However, they were willing to do a reduced final settlement offer which I then put on my credit card ... 6 years later here I am
.
I think it'll be very hard to actually get the debt written off as it's like someone running up a debt on a secondary credit card with your account but by all means have a go. If you have any paperwork that would prove the ex ordered it without your knowledge or permission that would help ...

hi , there is no need to get worried about this . Hope you kept the letter , that they sent admitting they had no CCA . I would send a copy back to them .0

Thanks for your advice. It just seems so unfair. I never opened the account in the first place and they are also unable to furnish me with any proof of delivery or the CCA. Its for over £3000 as well and I don't see that I should have to pay for a con artist

hi only seend them phot copys of the letters as also send them recorded delivly. just in case that thay say you have not sent them.
Dont worry if you dont get anywere with them and thay insist on takeing you to court then let them
as long as you have the letter saying off them saying that its not your account and that thay sont have the peper work for the account then i dont think that there is a lot thay can do. The court will not be intested in them.
But keep hold of that letter.

I would suggest that you spare yourself the expense of sending things recorded delivery and opt for registered post, as that has to be signed for as well.
i would strongly advise that you get your credit records and check whether there are any other nasty surprises, make sure you have closed any joint accounts and consider getting a CIFAS warning on your credit records.If you've have not made a mistake, you've made nothing0 -
Thanks Ras, I never thought about my credit file actually. I'll get onto that. What is CIFAS though? I've never heard of that before. I did contact the police and whilst they were very nice they did state that they are unable to locate my ex and until they can prove that he is reponsible that no crime has been comitted. Is this true?0
