I'd ignore the union & look at taking it to tribunal - there's a government web page here: http://www.employmenttribunals.gov.uk/ and it's worth contacting a local solicitor - most will give a half-hour session for free to discuss possible options.0

Contact ACAS - inform the company's Personnel department that you're doing this. Also request the union send someone with you. You've been treated dreadfully.0

There are strict time limits and processes to take a matter through tribunal, ACAS will be very unlikely to help you due to the length of time that has passed.
You could put this matter before a County Court but it would be costly and again due to the lenght of time that has passed, probably not worth your while or effort.
To even put in a claim for unfair dismissal with an Employment Tribunal you must first have gone through grievance procedures and there are restricted time limits as to when you can approach the ET to submit a claim; which after 4 years is way too late im sorry to say.
You have very little recourse now other than to pursue this matter personally using private legal proceedings.0 -
Presumably there is no legal recourse or the solicitor would still be involved? Often early retirement or medical retirement is limited in scope or not always within contract or within terms and conditions of pension fund.
My own firm does not do medical retirement at all, merely dismissal on capability.0 -

I think the treatment you've received has been appalling, some people need to hang their heads in shame, who is this "National Company" that you worked for, and this so called great union, expose them, you have no allegiance to them now :mad: :mad: :mad:
As for:I have been to a Solicitor who told me to write to the Managing Director at the company and to the top man of the Union.Presumably there is no legal recourse or the solicitor would still be involved?
I suspect you've only visited a solicitor on the High Street, and not someone "Experienced" in a particular subject, lawyers specialize in “General Law” “Criminal Law” “Medical Law” “Employment Law” etc,. etc,.
What I suggest you do, click here and enter the details required, what you're looking for is a solicitor who is a specialists in "Employment Law" within the area you are located, if your unable to locate one on the website, use the “Contact Us” function on the website and someone will be able to assist you.
As for the previous lawyer you saw, why did he have you write to the company / union instead of writing on your behalf?

I did call an employment law lawyer who was not very helpful, he just asked, why did I leave it so long? and if I wanted to he who look at it for £250 per hour, but he thought it was a waste of time. He said this in a not caring sort of way. I don't know how he thought it was a waste of time without looking at all my papers.
He said it was a waste of time as you are outside of the time limit for bringing a claim for Unfair Dismissal, under the Employment Rights Act.
It sounds as though your employer "dodged" the Appeal/Grievance Process, in the days when it wasn't compulsory to have one. Unfortunately, your employer took advantage of your lack of awareness of the process/law.
As you have no right to take this to Tribunal, I strongly suggest that you put it down to experience. It's not fair, but then there will always be those in life who take advantage of those who "don't know better".
Move on - sorry, but you have no statutory right to pursue this.Warning ..... I'm a peri-menopausal axe-wielding maniac

It may be worthwhile arranging some counselling to look at your feelings on this issue, and how you can move on from it. Your GP should be able to refer you, although there may be a waiting list. Alternatively, the GP will probably have a list of private therapists in your area?Gone ... or have I?0

As others have indicated, time is of the essence and unfortunately you are now time barred.There is nowhere to go with this that will benefit you. There may be grounds to bring a complaint to your ex trade unions hierarchy, but even if thats possible it would likely result in a procedural review at best.Don’t be a can’t, be a can.0

Personally I'd be tempted to take this public, and name and shame the company who can treat someone so badly, as you indeed running out of other options.
The very least the union should do is pay back all those years of contributions if they did jack sh*t to help!Should've = Should HAVE (not 'of')
