Some help needed please - Bryan Carter & Co

Hi everyone

I'm on a DMP with CCCS. Most of the creditors have accepted our offers of payment - which, of course, is good news.

One creditor in particular is proving to be very difficult. Argos Additions, has passed my debt from one DCA to another (I've lost count). Red Castle passed it on to Fredrickson and now Fredrickson appear to have passed it to solicitors Bryan Carter & Co. Of course they are threatening immediate court action.

Now, I am very wary about this letter as from what I have read about these people so far, they actually follow this through and issue proceedings (gulp!).

So, what I need help with is requesting the original CCA agreement. Do I:

1. Request it directly from Bryan Carter and provide them with the £1 postal order in their name; or

2. Request it directly from Argos Additions at whatever their address is with the £1 postal order to them and just copy in Bryan Carter so that they are aware that I am now disputing this debt.

I'm assuming I can by-pass the umpteen DCA companies who popped up in between?!

I am really, really worried about this one. Would you believe it is for a grand total of £328 (oh, if they get their way the claim will be for £411).

Has anyone else had any dealings with this company? Oh, and I will be contacting CCCS to let them know about the latest turn of events a little later on.

    I wish i knew the answers.

    I too have been passed To Bryan Carter.......from Fredricksons..........

    My debt is with littlewoods, and this must be the 4th Debt Collection agency to be involved.

    And like you , this time i've felt very uncomfortable and nervous about them.

    My other creditors have eventually played 'ball', but this lot wont, and i too am scared!

    Hi sunshine,

    Not my area of expertise, but I think you have to request it from the DCA once it has been passed to them. CCCS or someone else around here will be able to tell you for sure. There's a template letter around here somewhere you can use to request it - remember to send it by Registered post (so they can't 'lose' it) and to print your name only, NOT sign (so they can't try forging your signature to 'create' any paperwork they lack...).

    Request it from from whoever is hounding you . It is their duty to supply it even if they are acting as agent . IF THEY SAY ANY DIFFERENT ITS B-LL SH-T .
  • Hi, just wanted to say a quick thanks. I've had a death in my family and I'm not with it today. I will have to sort the letter out to post tomorrow with the postal order as that's the only chance I will have to get near a post office.

    I will send to Bryan Carter and keep everything crossed that I can either manage to stall any proposed proceedings or win the lottery to be able to just pay it off. (what's the chances :confused: )

    Oh, I didnt even get manage to get in touch with CCCS with having the other bad news.

    Its not that I'm trying to avoid paying the debt at all - I would just rather try and pay it back without having a CCJ added to my name. I'm depressed enough trying to sort the debt out. I know its "only a piece of paper" but ... well, you know what I mean :o
