1st Credit

Hi, can anyone advise,
I had a loan with Abbey for £10,000 for home improvement which despite my best efforts to keep up payment when I lost my job I eventually ended up with about £400 arrears.
I took out a DMP when I finally got back into work and began paying Abbey (and other debts) through the dmp just over 2/3rds of the original payment. Although Abbey accepted the payment they still passed the debt on to 1st Credit who have been hassling me by post and phone ever since. I refuse to talk to them on the phone and passed their details on to Payplan and the payments are now being paid to 1st Credit.
Today I have received a letter from them stating I still owe the outstanding amount(which is about £2500 more than what I originally owed when I lost my job) and that they have obtained information from the Land registry that I own my house and are consulting their solicitors as to whether they should seek a ccj and a final charging order against my property or even that I be made bankrupt. They end their delightful letter by stating they could apply for a court order to make me sell my property.
I acknowledge that I have debts and just want to pay them off like everybody else does but is there anything I can do to stop this action?

    Hi Caza,

Yes, there is - for starters they are talking pile of scaremongering twaddle! Again...

Unfortunately this isn't my specialist subject, but there are plenty of people around here who can help you with how to tell them to get lost in more legal sounding terminology. ;) If none of these have spotted this thread and posted by a reasonable hour tomorrow, feel free to post in this thread again to bump it back to the first page. :)

    Hi
1st credit are well known for this - just search the forum and you will find many threads about them.

I would say that they are scare mongering. Just carry on paying them as you are via Payplan. They will spout all sorts of crap including that they don't accept payment plans but I've been paying them via CCCS for the last 6 months. They will give you all sorts but I think they realise that if it goes to court that the court will see you are making every effort to pay them.

That said, please be aware that Worst Crudit are a law unto themselves and break every rule in the book so I would still be careful with them.

Speak to Payplan and see what they suggest.

  • Thank you both,
I will take you advice and repost. I would like to write to them (and there are lots of things I would like to say!!) but I want to make sure I write the correct thing and I certainly would like to know where the extra £2500 came from!

No idea, but they'll probably try and claim it is their 'fees' or something equally ridiculous...

You said you were being hassled by phone - have you sent them a 'cease and desist, contact me by letter only from now on or you will be breaking the law' letter? If you haven't, some people around here have a template letter you can use.

One work of warning about writing to them - NEVER sign your name on it, just print it, and you should also never send them any photocopied documents with a signature on. Some of these lowlifes aren't above forging signatures to 'legitimise' your debt with them given a genuine example.
