NatWest CCA.

I sent a CCA request to Natwest which was delivered 30 September. Today, I eventually recieved their response (dated 31 October)

No CCA, but the last statement, current T&Cs, a document pertaining to be a credit agreement (copied and pasted by look of it given it specifies my current credit limit not the original limit and mentions default charges being £12) and illegible T&Cs which i assume are the original ones.

I just want claification of the secon paragraph really which states.
your written request for info' made under S78(1) of CCA must be accompanied by £1, which we have applied to account accordingly. We are obliged to provide you with a 'true' copy of the credit agreement and a statement of financial info relating to the account, namely the state of the account, amount currently due, with amounts and due dates of futher payments that still need to be made. In terms of CCA copy document regulations, the 'true' copy requirement can be satisfied by providing a copy agreement at the date the card agreement was made and providing that plus a copy of the current terms of the card agreement.

Its the last sentence really - is that actually correct (providing the original terms are legible)

They also make a random, rather superfluous statement of we have not sold your account.

    Its a Credit Card (taken out roughly end of 98 beginning 99)

    I havent as yet - reasons for requesting it were to try and get them to lower their interest rate (have tried before, but without any info) and for information purposes.

    I can make out some info on the original T&Cs and from dates on them (it mentions electrical equipment and the millenium bug) they are from the correct time. I can just about make out it says your credit limit is waht we advise you, so initially, it looks like they have the 'prescribed terms'

    It would appear so at first glance.

    the original T&Cs are a little ambigous in that the seem to apply to several different accounts - ie if its a mastercard.... if its a visa ..... if its a gold card...

    there is a table of APR rates, but agib, like most of the document, its barely legible and would take some reading.

    Looks like that is Natwest's/RBS's standard letter that tries to fool you into believing they have complied with the CCA request. :rolleyes:

    The law requires that they send you a copy of the "executed" agreement and any documents refered to in it.

    Current terms and conditions just don't hack it for this purpose.

    Thats what i thought fermi. Thanks for that.

    As I said, all I have is the current T&Cs, old (barely legible) T&CS and what look like a copied/pasted credit agreement, with all prescribed terms included - but its post 2006 and is apparently a copy of my agreement correct as of my last statement date.

    Just to clarify, when was the original agreement made and when is the agreement they sent you from?
