Cancelling the Gym...

Hi folks! i hope you can help...

My local Gym is closing down on December 7th and they dont have a new site opening in the city centre. They sent me a letter to let me know that my membership will expire on the 7th of December. In the mean time i saw a very good deal elsewhere so i cancelled my direct debit with the old gym and sent them a letter explaing why. They have now got in touch saying i need to pay for my last month?

The way i look at it is...i was 4 months into my 12 month membership with them and then they decided to close...so therefore surely the 12 month agreement i signed is void?

I said i would call them back later in the week to discuss it...am i right in my thinking that the contract is void? I refuse to pay for something i am not going to use!

Any advice much appreciated!

  • It depends how the contract was worded. They are usually one month's notice on either side AFTER the minimum contract period has ended, but this is very unusual circumstances, with them closing down. I can't see how they can enforce that one month's notice when they have clearly broken the contract by closing the gym and terminating so early! It's not as if you have a choice whether to leave or not! I'd imagine that whatever the outcome of the month's notice, they're not going to be in a position to chase it for very long are they!
