    Yes, of course! 6 years is only the maximum time you can go back to reclaim over. If you have only had the card three years, you can get back all your charges for those three years. :D

    Regarding the man on the phone, you have to remember his job is to stop you trying to claim your money back by discouraging you, and to talk you into giving them as much money as possible by whatever means necessary.

    So, abandon the phone approach and go for the template letters by registered post. You should expect them to refuse you a couple of times, but remember that what you were told on the phone was incorrect - the charges have already been ruled illegal by the courts so you are entitled to them back!

  • Can anyone tell me, do you have to clear off the balance on the Halifax card before starting the claim for PPI? Just wondered whether they'll immediately close the card and demand payment in full before looking into a claim or complaint?

  • :money: An soa is a statement of affairs. Here's a link to the site where you can do it. Format it for mse (there is a button towards the end of the form) and you can then post it on here for people to halp you see where you can make savings etc.

  • They won't close the card - at least they never did with me. They just credited the money they gave me back onto the balance of my credit card wiping off £600 in one swoop! Was a great feeling! :j

    Keep a note of everything you send them and also keep a record of the recorded delivery letters you send and mark the dates that you expect responses from them in your diary. When they don't respond, hit them with the next letter. It's your timetable, so don't be put off if they say things to you like, "We'll respond in 8 weeks". You dictate the timetable.

    From start to finish, it took me about 2 months from the initial subject access request (where I asked for 6 years worth of statements) until receiving the money in my account. As you don't have to get the statements through, you could even get this quicker. Don't bank on it though, but just keepyour fingers crossed for an early settlement.
    Almost debt-free, but certainly even with the Banks!

    No - you can ask for this at any point.

  • Oh, should have added that you should mention hardship at every point at which you write to them. It adds to the weight of your argument and if - and they tend to pay out before needing to go to the Ombudsman - you need to refere it to the FOS, demonstrating hardship often allows your case to be heard quicker (or so I believe).

    as i said before i posted a complain letter to halifax credit card and also posted the 1 st letter for charges with the 10 pound cheque. and to my surprise. yesterday i came home and got a letter from debt collectors halifax has give my account to debt collectors. i don't know what else i should do right now start paying. at least i hope they won't keep charging me . i am sure it this nasty block i spoke to last time who took this decision any way..... do you think it will have an effect on my claim for charges or should i just continue the process without taking into account the debt collectors it is such a nasty position to be in. i am shoked. HELLLLPPPP.

    Just carry on with your claim to the Halifax, it's them that took the charges from you, so they should be the one's refunding you, as for the DCA, don't get involved with telephone conversations with them, everything should be by letter only, don't put your signature on any corespondence, just block capitals. Also don't be intimidated by the DCA, they only want to get as much money out of you by pressurising you.
