bancrupcy and bank account

hi i am in a no win situation and my only option is bankcrupcy.
my question is i have a bank account that i have never used, and dont owe that bank any money, with no overdraft facility.

i am not declaring this account to the official reciever, im sure i shouldnt be doing this. can he find out about this bank account? does he do a search or something? i here its a knightmare to get a bank account after bankcrupcy so what what harm am i doing?

  • Shouldn't your affiliation with this bank show up on your credit report? I know all the banks I've ever used and all the accounts show on mine. I think it is still possible to get a bank account after bankruptcy? I know Abbey have a "basic account" with just a cash-card, and I think others do similar. Others should be able to confirm this as the case or not!

    You should declare all your bank accounts in the relevant section of the form.

    If you are intending to use the account to bank your regular income then you can tick the appropriate box. The OR would not freeze it, though the bank branch might.

    You should not deliberately withold information. You will be swearing on oath as part of the court process. Of course the OR will do a search. Their job is to look everywhere for sources of cash that can be used to pay your creditors (and their fees!).

    Have you taken proper advice on bankruptcy from one of the fee-free charities?
  • yeah taken advice, its gone too far for me mate. we handed our house over to the morgage company on a voluntary repossession basis a couple of months ago, tried selling it myself as i could see this coming about 6months ago, even knocking £45,000 off the valuation price didnt help, couldnt drop anymore coz it would be in negative equity. the morgage company have it on the market for less than whats owed on the morgage. at xmas it was valued at £155,000 (morgage was £107,000), now its on the market for £102,000. (for a big 3 bed semi with 20ft conservatory!)

    now renting privatley. basically careless borrowing has got me into this situation, theirs no way out now.

    went past my old house the other day and it has been trashed by kids, broken window etc....(and that was after the valuation!! so its worth even less now.

    i am filing for bankrupcy end of month when paid.

    basically i was going to change all my dd's to this account, rent etc.... dont really want my landlord finding out tbh. plus my wages i was gonna change to this account aswell this week. as my abbey account is soooo overdrawn that my wages wouldnt clear it, (bank charges etc.... from bounced dd's)
    then i wouldnt have enough money to pay the bills this month, so i gotta get my wages paid into new account.

    cant go to abbey cos i owe them money and have my current account with them, but dont owe any other banks money.
    i keep reading that if you declare your bank accounts they all get frozen?
    basically i work part time for a company (less than 16 hours a week, earn £400 pm) which i want to have the wages paid into my lloyds tsb account from next week (the account i have never used).
    and i have my own business which earns me about £400-£500 per month at moment, people pay by cheque so how the heck am i going to get another bank account for that?( thats a business account with lloyds)

    the business is classed as self employed, no assets or debts.
