02 - Buchanan Clark and Wells letters

Hi,

Today I received through the post a 'FINAL NOTICE' for a debt with 02.

Considering I've not received anything from these guys EVER before I'm totally confused! =/

The letter says I owe £25.17.

I had an 02 phone which I cancelled at the end of the contract 2 years ago. I phoned up and they told me to send an email just for final confirmation. I did this and received nothing back. I happened to change my bank account at the same time so did not transfer the DD as it was in the process of being cancelled. However I noticed 3 months later I noticed that 3 further payments had been taken from this old account (which I kept open and thankfully had an overdraft). I phoned 02 to query and was told they never received my email. I fought for about an hour and finally they said if I could send them email again by email and fax they'd close the account with no final charges as they'd already taken £75 more than they should. I did this and the DD was cancelled. Never heard a single thing from 02 again. This was an online account so very rarely did I receive anything through the post.

Now I've received a letter from Buchanan Clark and Wells saying I owe...?! I dont know what to do! I've tried ringing all day but getting a message saying to call back later. Cant get through to anyone at 02 as I dont have my account number.

Any suggestions?

    Hi you need to speak to them really. But dont pay anything untill thay prove to you that you owe them the money
    I dont know what else to say to you. Maybe someone else will come on tonight that might know whats best to do.

    Send BC&W the following. do not phone them at all ever.

    You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.
    We would point out that we have no knowledge of any such debt being owed to The Loan Company.
    We are familiar with the .Office of Fair Trading Debt Collection Guidance, which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
    We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
    Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
    We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.
    We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.

    My daughter has been abroad for two years and she had the same letter in October this year for £17.99 owed to Orange PCS Ltd - since I've had all her post for two years how come I never saw the so clled previos correspondence.

    I emailed them to ask for the proof of debt.:D

    Write, not e-mail. The legal status of the two is different,

    And when you DO write to debt collection companies, NEVER sign your name, print it only. Some of these companies aren't above forging signatures given an original to work with...:mad:

    Recorded delivery is also worth the money, too, prevents them claiming they never got your letters.
    Never underestimate the power of the techno-geek... ;)
