Think Ive pulled a clanger!!
OH wrote some cheques for the Money shop (£700) in order to get the cash for BR tomorrow, (didnt have any other way of finding the funds and read on here it was only the same as using credit card to pay the fees).
The payments wont go out till next month but Ive now just realised that going to be a debt after bankruptcy and we will still be liable for them wont we??

    Depends which account they will be coming out of, are they from an account that is going into BR, or your new post BR account? If they're from an account not going into BR then yes I think you will be liable as they won't be presented until after your BR and in order to get them included you will have to include that account.

    If you have used the 'loan' to pay for your BR then by definition it can be included in your BR as a loan at the BR date/time.

    Shouldn't be any problem at all - just make sure Money Shop are listed as a creditor on the forms.

    The OR assistant that rang me in court after I saw the judge actually asked where the money had come from for the fees, had I borrowed them I said no, he said not from a family member even, I said no the fees were my own money.

    So maybe you will get the chance if you are asked on the day to say where the money has come from as well.

  • Hi RL, I don't think that happens everywhere. OH didn't get asked where he got the fees from, so I think it depends on the court / individual OR office. It's a good idea to talk it through with the OR's office when they call, tho - they seem to be very helpful generally and will certainly clarify the situation. CBx
