No copy of CCA after 12+2 days are up - what next?

14 working days ago I sent a letter to IQOR asking for a copy of my CCA, complete with £1 postal order. They acknowledged receipt of the letters I'd sent, including ones about phone calls, and said the CCA request will be dealt with separately. Today was the 12+2 day and no CCA so what letter do I send to them now? And if they don't come up with a copy of the CCA what do I do then? They would have had their first payment though Payplan today so should I stop Payplan paying them any more and hold onto the payments?

    How much are you paying them ? I would carry on with payments and what till the 12+2 +30 DAYS . If they do come up with CCA then you are covered . If they don,t send off the default letter .
  • Do I now need to send them another letter or do I just wait another 30 days? And is that 30 days or 30 working days?

    I used to be 30 days, but the status of this is a bit in the dark with the change in the law.

    Anyway 30 calendar days.

    Do you already have a default for this debt?

    I do have a default with this debt, then it went straight to a DCA. It was originally with MBNA.

    Do you know how the 30 days is changing/has been changed?

    Soory but there is a change in the law for debt accrued since April 2007. for reasons I do not understand, this will change the 30 day rule but

    a) English law is not retrospective, just DCas cannt keep two thoughts in their collective brains so are lilely to say it is irrelevant.
    b)Until someone goes to court n it, the exact situation will not be clear.

    So, you could just stop paying, as they cannot enforce the debt until,the CCa is delivered.

    or you could wait until the 30 days is up and then stop paying.

    Up to you.

    They cannot touch you legally.
