Who owns the car???

Hi
My ex boyfriend bought me a car a year ago as a gift. I traded in my car as the deposit and the value they gave was £2500 for my car. He then paid the rest on finance about £11 000. The car is registered in my name but he is paying the finance. We broke up over two months ago and he has emailed me to say he wants his car back. May someone please advise on my rights, if any. I am quite distressed as I need a car to work and to do the school run.
. He said he wants the car within a week and that I should hand over registration documents and keys. HELP!!!

If the car was financed on HP then the actual answer to your question is easy - the finance company own the car, and they are HIRING the car to your ex boyfriend.
If the finance agreement is in your ex's sole name and presumably he has a sales receipt from the car dealer then he's got a good case, escpecially if he can prove that he has ben making the payments.. The registered keeper is not necessarilty the legal owner.
If, however, the finance was not secured on the car and was just an unsecured loan, then you could argue over the 'gift' element of the purchase and probably claim title.
Can you please post back with the type of finance agreement as it is likely to make a difference here.
If the car does end up going back to him, and you two are on speaking terms then it may be worth coming to an arrangement over your £2500 contribution to the car, which would only be fair imho.0 -

Im in exactly the same situation, my partner is paying the finance, through a finance company, he can't afford to keep paying it and now wants the car . Can he take it from me ? He has proof of payments and car dealer receipts.
What can i do if he takes it??? He has offered to sell it to me. some people say i own it because im the keeper but some have also said he does because hes paid for it and still paying... HELP!0
