I'm sitting here devastated!

I came to the realisation lat June that I was going to end out in (even more) serious trouble if I didn't do something o sort out my financial mess. I sat down, panicked and cried a lot, wrote it down, called for help and eventually was put in touch with PayPlan.

After days when I had up to 100 calls a day, I have now made 3 DMP payments, feel very poor as they are massive, but felt I was getting somewhere. Tonight I feel devastated and defeated because of something that I discovered an hour ago.

One of the debts I had was with a really "reputable" short term loans company called same day cash. I took out a Payday loan for 800- to pay back 1083 and defaulted. I just couldn't afford it. By the time Paypla got in touch with them is was over 1325 but even though I checked every few weeks the balance didn't change. Today I logged into the account and was panicked to see it was up to 1789 pounds. I contacted Payplan who for the first time said that hat they hadn't bank details and a DMP hadn't been arranged with SDC.

So I decided to call SDC and this lady who was really horrible to me, told me it was company policy to not accept DMP's, and that I had to pay in full. Apparently my 12 month DMP was too long a time to wait for their money. I said I obviously couldn't do that, or I would have done that already. I was like look 400 pounds could already have been aid if you'd provided you bank details, and by the time you take me to court this could all have been paid off. She was having none of it, and said she'd fast tack the court action.

I just feel like I'm in loads more trouble now. I can't afford to be made bankrupt, I'm a teacher... and schools really care about this sort of thing. It's even on some LEA application forms.

Surely a court would see that I pay off as much as I can every month and that I\ve doing my best. Payplan said that they have legal advice should SDC push for this.

I just can't stop crying about it all... I felt like I was getting somewhere and even though I have nothing at the moment there was light at the end of the tunnel.

    Call National Debt line 0808 808 4000 - they will give you advice.

    This is why it pays never to talk to these people on the phone. They are bullies.

    If it does get to court, you can prove that you made every effort to pay them but they refused to to accept the payments. That will not look good and tyou will get to pay them even less than they are currently receiving.

    This company is probably in as much financial trouble as you are and they are desparate, hence the bullying.

    hi - please, take a deep breath and get a cup of something hot and sweet.

    If it is all you can afford to pay them, then that's all they will get, even if it goes to court, the worst that can happen is a CCJ (which LEA's aren't bothered by or will even ask about) and if you have proved your income and expenditure it will be set at an affordable level which they can do nothing about.

    The chances of you being made bankrupt by these shady characters (and that's a mild description of them) is slim to nil.

    They employ people who are, as RAS says, bullies.

    Thanks RAS, you've made me feel a bit better- didn't think that was possible today.

    I don't know what was worse, being in this position (debt ridden and broke), or being in the position where someone felt the had the right to make me feel so awful. Talking to a brick wall is never nice.

    Firstly: She can't "fast track" any court action :) It takes the time it takes and that's all there is to it :)
    Second: NEVER phone them again. Let PayPlan handle them - this is what they do.
    Thirdly: Deep breath - some companies will try and be nasty and horrid but they CAN'T HAVE WHAT YOU HAVEN'T GOT! It's that simple :) IF they try and take it to court then you can show you have tried to pay them and tried to sort things out - if you pay them any more than what Payplan have set then then you will be showing them preferential treatment and payplan will not help you as you'll be breaking the DMP terms

    Just popping by to wish you luck. I think as well if it went before a court that a court may decide the interest on this type of loan was unjustifiable and might get what you owed reduced anyway

    Do any of ye know how long it takes to normally get taken to court?

    I'm a bit worried about PayPlan, and what they're supposed to do for me. (Don't get me wrong they've been great in many ways) It's just I had no idea my DMP had been rejected and neither did they, they told me to contact SDC when I called, so I did. 4 months is a long time to accept silence from a company isn't it? SDC said they couldn't talk to PayPlay, but I have given authority to PayPlan so surely they can? I'm not really sure what anyone is supposed to be doing anymore.

    I'm just really confused, I thought it was all sorted out... and it turns out that 2 of my creditors haven't corresponded with PayPlan about it at all.
