I'm back...aktiv kapital have been in touch again...help?

Hi i've received another letter today from Aktiv Kapital in response to the one i sent stating that i was not acknowledging the debt of £552.25 (which they say was from 6 years ago) and bought by themselves from G E Capital which i thought was paid off before i moved abroad. They haven't given me any information in the letter regarding whether they had the original credit agreement and, a few of you may remember that the awful girl on the phone when i foolishly rang them told me they didn't need it? They have written that the account was legally assigned to there group and, they have been trying to contact me.

They say it is imperative that i contact them to speak to one of there negotiators and, that is all the letter says. I'm not sure what to do now as they haven't responded to any of the questions i put to them regarding the credit agreement and dates/payments i was supposed to of defaulted on...i would appreciate any advice...thankyou:o

don't phone them, they are there to get you to pay not to negotiate.

did you send them a cca request letter? or was it a letter asking for details of the debt. they have to prove you owe the money not the other way round. If they can't be bothered to answer you - probably because they don't know themselves why should you be busting a gut to reply to their nonsense.

If I phoned you out of the blue and said hey you owe me £50 you'd tell me to get stuffed wouldn't you! Treat them the same.

If you need a template CCA request letter you can find one here. Also if you start receiving phone calls (they like to make calls these people) then again say so as there is a template letter to stop the calls

Thanx for the advice all those that replied i have down loaded the CCA request letter and will post it recorded delivery with a £1 postal order inc to request a look at my credit file .....i hope this may be the end of it it's making me worried! x:A

if this debt is this old, it may well be statute barred.

Have you paid or acknowledgged it in writing any time in the last 6 years/

can i just add to this one, i went to aktiv kapitals website and on it is a bit for CSA guidelines along the top on the right, go on it and fill in the complaints form because, aktiv are a member of CSA credit services association for short, they have guidelines they have to follow, i had quite alot of dealing with aktiv even after requesting cca, they told me they were not obliged but they are even if they are not the original creditor, anyway cut a long story short, i complained by filling in the form and sending them copies of all letters to and from aktiv and within a week i heard back from csa saying they will investigate and then within 2 weeks i had a letter from aktiv kapital saying that the balance of 1.425 was wrote off and i will hear no more from them, so give it a go, maybe just maybe if we all complain to the csa then aktiv will have license revoked for unfair practices in collections.
