If a couple are going through a divorce at retirement ages

and one of them passes away ( i do not wish this) would the other one get automatic rights to their private pension? just useful to know! thanks in advance.

If they are not actually divorced and no other provision has been made then yes, they would get the private pension along with the other assets.
Provisions in relation to the private pension should also be made as part of the divorce settlement.0 -
Another point also,if they die before a divorce goes through the otehr party can claim part of their state pesnion as a widow (basic pension topped up + % of Additional Pension)I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0

What kind of "private pension"?
Some rules require that you are married and still living with your spouse at the time of death, in order for the spouse to automatically receive benefits from the pension - this is especially true in many occupational pension schemes. In other words, if the divorce is not finalised BUT they are living apart, payment may not be automatic.
Depends on the type of pension and what the rules state.Warning ..... I'm a peri-menopausal axe-wielding maniac
