Default Letter Arrived! Please advise me...

Hi everyone, hope you are all well today. Just want a bit of advice....

I called the CCCS about 3 weeks ago to get the ball rolling on sorting my life out and clearing all my debts. Found them very helpful and friendly, they sent me the pack etc which I sent back to them the beginning of December. I also sent out the notification letters to all my creditors at the same time informing them that my DMP starts in January.

I got a default letter from Egg yesterday for £56 pounds saying if I do not pay this by the 18th December they will request the full amount from me which is £2,356, or start legal proceedings or sell my debt on. It's the first default letter I've had, so I'm not sure what to do. The annoying thing is they apparently sent the letter on 8th December. I know snail mail can be slow but that is just unreal! I have left a message with my CCCS counsellor asking for her advice...do I call Egg and tell them about my DMP as it sounds like they never got my letter, and there is no reason why they shouldn't have. Or will the CCCS need to speak to them?

My boyfriend said he will pay this for me by the 18th if necessary so I know it will all be fine but just wanted your advice please? Thanks. x

  • Hi Don't panic. Egg are trying their luck. Send the letter to CCCs and let them deal with it. Do not pay it, they will come after more. They have had your statement of affairs and they are choosing to ignore it.

    It is upsetting but maybe you let your boyfriend open these letters and keep you out of the loop. You are dealing with the problem and the credit cards etc will try and bully you. Do not let them.

    It's normal to get default letters while with CCCS, like Louise has said just forward letter to your debt counsellor to deal with for you.

  • Thank you both very much...it's just your heart jumps in your throat when you see words like 'Legal proceedings'!!

    My counsellor just left me a message just advising me that it's a standard letter and to file it away. My mind is at rest for the weekend!

    Laura, like others have said, it's a bullying tactic used to scare people into paying. Those that are not clued up about the consequences will be terrified by it and worry themselves sick.

    Fortunately, you've been in touch with CCCS and post on here, so you're not in the dark!

    I have to say, don't expect it to be the last snotty letter you receive.

    Don't ignore any of them (give them straight to CCCS), but try not to be intimidated by them.

  • I was hoping for a while that they would all go along with me entering onto a plan and I would hear nothing more! At least I know what to expect now and I won't even think of burying my head in the sand, that's how I got into this mess. I will forward the letter right away.

  • Just to let you know that I'm with CCCS and the same thing happened to me. In fact I received a default letter earlier this year (I'm in year 3) when the bank passed the debt on to their collection agency. It will happen, and all I did was ring the agency to let them know I was with CCCS and that I would be arranging to have the payment sent to them instead, and then passed the letter to CCCS. Each company has different procedures of dealing with your account. Just stay calm about it, assure yourself that you're with CCCS making payments, and most companies will be reasonable about it. All have with me.

    Also 'happened' to me and yes it does make your heart jump when it says 'Legal proceedings' :eek: :eek: :eek: these are computer generated letters!
    Your name will go into the database system that send out these letters (Mail Merge)

    I have a stack off these letters all saying the same old ****. :whistle: :whistle: :whistle:

    I have been with CCCS now for 9 months, Great service and now online accounts (can it get better?)

    I would send any letters on to CCCS they will 'action' them.

    In a strange way thats what 'they' want you to do! Keep in control of the accounts.
