Getting An Ex Off Mortgage

Can anyone advise us of how to remove an ex off the mortgage, if her name is on it , she ahsn't lived there for 12 months and there is no equity in house.
She doesn't want the house but says she is been awkward cuz she can.....
please help!!

She owns the house with you so has a right to stay on the mortgage. Though she is jointly liable for the debt to, so lord knows why she would want to be.
You presumably want to transfer ownership of the house and the mortgage in to your name.
Firstly, get verbal confirmation from your lender that they will allow you to hold the mortgage in your sole name. Remember, they could refuse - in which case the points below should be ignored.
Secondly, see a solicitor for advice on how you can legally remove her. She probably wants money, although as you have no equity is unlikely to be entitled to any.
Finally (subject to your solicitor's advice), work out the value of the house. If it's less than the mortgage debt, tell her that your solicitor has said she should pay you an amount equal to half the negative equity to get out of the mortgage. If she refuses, say you'll accept a quarter and have a final fall back position of letting her get out of her commitments for free!
Finally, threaten her credit rating. Say your hours have been reduced at work, you can no longer afford the mortgage and as she is jointly liable for the payments she should be making them in full. If she fails to, she could end up with a repossession clouding her credit files for 12 years. (This isn't suggesting you damage your credit file by not paying, but it does draw to her attention that there are risks for her remaining on the mortgage).
