final query before BR

can anyone help with this query? im about to go br, ringing court today but something just made me think...ive split up with my expartner and she lives elsewhere, and has done for 6 months with our son..my house is still in joint names tho until fixed rate deaal ends in 2 years and i cant get it off as ive no one else to put on at present and my earnings are lower than wen i got the mortgage so i cant just remove her.. when i go BR..even though the house is in negative equity and i can prove i can continue to afford it following BR... will it affect her at all?

As long as you stay in the house and keep up the mortgage it shouldn't effect her, other than the Land Registry writing to her informing that the OR has an interest in the property.Accept your past without regret, handle your present with confidence and face your future without fear0

if your OH is a joint mortgagee you may need her agreement to sell your Bi and who too, she is, after all, 50% responsible for all aspects of the property
maybe for the £250 she may want to buy you out and rent it to you
she could block or revoke your sale of your Bi if she hasnt been informed, after all she would be liable for ALL the total shortfall (if she isnt going BR) should you fall to keep up your repayments.Now we all know how it felt to play in the band on the Titanic...0 -
No need to buy the BI if the house is in neq equity, indeed the OR may not offer.
The BI has nothing to do with the mortgage, and buying the BI doesn't change who the owner of the house is, it only protects any future equity.Accept your past without regret, handle your present with confidence and face your future without fear0 -
thanks for response...she has no interest, positive or negative and im very confident that wont change...i dnt want my decision to impact on her or my dependant hence i ask the question..jsut unfortunate that im unable to remove her...my bankruptcy has been held back whilst i wasted time and 400.00 finsding this out......thanks and got my date...13th nov...eeeeeeeek0

hi sandy..thanks for that..really wired with it at the mo..no matter how much people reassure you know its such a serious thing and its wondering what theyll say and what will happen..just hoping my paperworks completed ok etc and the OR is happy with it all..cccs say i should be so thats reassuring but still..ill be glad when the 13th has come and gone!!!0
