OMG scared now

Just read a post on here saying about holidays and gambling may be seen as misconduct.
We had a holiday this year and had to use the credit card for the bill at the end of the week......we didnt intend on doing this ....but our debit cards wouldnt work...we later found out when we got home that we were overdrawn from charges. It was either use the card or not be allowed to leave the country.

What will they say ? and what can they do ?
im terrified now that they will not accept our bankruptcy

Help ?? !!!

    Hi Ems,

We paid for a holiday just before and just after our bankruptcy, and there were a few raised eyebrows but nothing serious. If you believed that you'd be able to repay the amounts then you've done absolutely nothing wrong, and if you weren't sure then just convince yourself that you were.;)

I had to re-schedule our meeting with the O.R because we were on holiday.

It won't have any imapct on you being declared bankrupt; if you're insolvent then bankruptcy is the remedy, regardless of how you got there.

    Regard

    phew...thanks richard....was really scared then.
We booked the holiday last year when our heads were still burried firmly in the sand, we used the credit card for the room /bar bill and had discussed BR a couple of weeks before we went but had no idea how soon we were going to act on it .

Im so used to being told NO, im terrified that there gonna turn around and say....''well you know what you got yourself into it, you get yourself out of it ''.....silly i know ...buy BR makes you think silly thoughts i guess.

  • When i went BC they wanted to know who we owed money to, not once did they ask what we used the cards for ,they did not care.
I did not even have to give any statements.
Donr worry they are not there to judge you and have no right to critise you.

Dont be scared.. I have a lot of these thoughts going through my head right now too. I have my OR conversation in 2 weeks and am dreading it as we did the same went on holdiday in May (my parents actually paid for the holiday tho!) but we paid for food etc out there on CC. Also literally within the weeks before we realised we couldnt afford anything anymore (denial I think) we bought a sofa and dining table on CC..

i will prob get told off for it but it wasnt until our last big purchase that the next day DH got told he wasnt going to get as much overtime anymore and we were like OH HOW WE GOING TO PAY??

I will update on my outcome once I know it though!!

  • Hi em,

I think these are just normal panicky thoughts - I'm feeling the same way, OH goes BR on Monday! I'm waking up at 4am thinking "What if he can't go BR? What will we do???" I keep having to remind myself that loads of people on here have gone through the same thing, and have made the same mistakes, and they've all been allowed to go BR. So we're no different! Just keep telling yourself it'll be ok - because it will!

ems - since you did not even intend to use the CCs, you were not intentionally taking out extra credit.
If you've have not made a mistake, you've made nothing
  • Hi Ems
Try not to worry too much. I cringe as I type this, but I went on holiday in May and Sept last year- bulk of it paid by credit card- and went bankrupt in March this year. Looking back on it now I just think "what was I thinking"?? But at the time I was convinced I could pay it all back and just needed to "economise".
I expected that to go down pretty badly/even get a BRO for it, but it was never mentionned.

It is just panicky thoughts- I used to lie awake imagining the judge would ring in sick and I couldnt go bankrupt/that the court staff would be really horrible/the (non ringing in sick)judge would shout at me, and the OR would be a total ogre and I'd end up in prison or something. The reality was totally the opposite so try not to worry.
  • Hi to everyone, my date is December 5th at 10 am.

I have been thinking exactly the same things, we went away in June for my husbands 40th birthday. Looking back, I agree, we should not have done it but had this stupid idea we could afford it. It was only because I asked if I could cut my hours down from 44 to 27 recently that I have had time at home to look at our finances and think no wonder we are getting nowhere. Too many outgoings due to me.

neverbeindebtagain...dont beat yourself up....i bet u didnt have to drag your hubby kicking and screaming on hols lol.....your a partership and entered into things together, now you have to do whats best for both of you and get through it together.

we were quickly running outta time with our situation....we could have carried on and racked up more debt on the CC's esp over christmas, but we choose to face this now....maybe not the best time of year....but betta late than never.
