Charging Orders France

If someone has a UK debt but owns a property and lives in France, can the creditors place a Charge on the property in France?
A case of beer has 24 cans. There are 24 hours in a day...............Coincidence?

  • I wouldn't think they would have any claim unless the mortgage was with a uk company.
    My ex was bankcrupt in the uk but had no trouble with bank accounts, credit cards, loans etc in france.

    Assests in each country are dealt with by the laws of that country ....& their courts! regardless of the nationality of the person concerned the fact that person is not even resident in the uk would make it even more difficult for the creditors.

    There is no mortgage on the property.

    I would assume the UK creditors would still continue chasing the debt, even if in France?

  • That would probably depend on the size of the debt, who the creditors were, if they knew where the person was and if they thought the hassle of going through another countries legal system would be worth it.

    I would suggest the person seeks advise from a solicitor with knowledge of both legal systems to find out whether a claim could be made on their property and if this is the case that they try to come to some agreement with the creditor. If they chose to ignore the situation they have to consider what would happen in the event they moved back to the UK.
  • Hi 1313, I spoke to a guy called Johnnie Debt who knows all about this stuff, he said I should ask Mr Spacey, the guy who was on Radio 2 the other week, a real debt celebrity apparently, knows' how to spin the creds and make 'em run for the hills.

    If the UK bank has a branch or subsidiary in France they will transfer the debt and come after you.
    Also, you own a house with no mortgage in France but won't pay your debts. Thats pretty naff.

    Hello IN LIKE EVERYONE ELSE! Sorry but that "Someone" is not me. So you also know Johnny Debt and Mr Spacey? I personally did not hear Mr Spacey on radio 2 talking about debt, but did hear it was well worth listening to. Any idea where I can hear it agian?

    I am KGB trained, creditors don't scare me!! Mother-in-law does though!

    I wonder why BT rang me today and offered me a £3.00 reduction in line rental, if I change to Direct Debit?

    So what about the house in France kids, can a charge be placed on the property??
