Can i really get the court order changed? or a new order?
I spoke to a solicitor who really wasnt very helpful at all...he basically said the order i have got says i have to indemnify my ex against any losses...meaning if i sell it for a loss now, even though the mortgage is still joint he is not liable for half the loss.
Also the order sayd he has to sign the deeds over to me...but i dont see any advantage in doing this now.
I just want the house out of my name as soon as possible.0 -
Hi
I too recently split up with my partner and he has been contributing to his half of the morgage even though he has moved out and is renting elsewhere. I really think you should chase your partner for any contributions he has not been making0 -
It sounds like you have already made the choice and the decision is final. you can not change court orders after the fact. Mine was incorrectly worded but the court still refused to alter it. You have to get him off the mortgage and he has to sign it over to you. It seems you now own the house whether it goes up in value or down. I'd look into mortgae deals and ride the storm if you can, otherwise you have to accept the lose. I'm in the same situation but am fortunate that i have good trackers on both my houses but would lose if i sell now and i had to pay my ex despite only married 4 months and no contributions from him.0
