List Of Disclosure - Std Disclosure

Hi everyone,

I am being taken to court by Weightmans LLP for a debt owing to HFC Bank. To cut a very long story short in August I received some papers from the court. I rang the court to ask if any action was required by me and they said no. Then approx. 2 weeks ago I received another letter from the court stating that the claimant had requested that I disclose all documents relating to the case and that I would have to pay the fee for the application of £144.

At that point I sent the court copies of all the relevant info. that I had, but yesterday I received a letter from Weightmans saying that I should have completed a List of documents : Standard Disclosure form (even though they received a copy of all my documents from the court).

I am in over my head really and am not sure what I am supposed to be sending and if they have the right to get me to complete this form or not. I tried to get some legal help from the CAB, but they said they would phone back and never did.

Can anyone offer any advice please?

    I believe you should send a copy to the solicitors as well as the court . Ring the nation debt line for advice , cab are just too snowed under. What is debt for ?
  • Hi it is for an old credit card that they turned into a loan I asked for a cca about ten months ago which they have only just supplied after starting court proceedings. When it went to court I did write to them and the courts asking for a cca again. Also as I know you have experience in this field, I have asked Halifax for a cca (I originally asked about 6 months ago but they ignored the request and didn't sign for the letter) so I recently asked again as they started chasing payment again and they have said they are too busy to provide it yet, but they stated that they have no legal responability to suspend collection activity while the account is in dispute is this correct?
