car expenses

I wonder whether anybody could help me please.

I was bankrupt between August 2007 to August 2008 so am discharged for two months now.

When I was declared bankrupt the OR told me to contact the inland revenue and claim back three years of motor expenses - I use my car for work and am paid 30p a mile - I did not realise that the government would reimburse an additional amount to 40p.......I did this back in August 2007 and the money/reimbursement was kept by the inland revenue to clear a small tax amount owed on a tiny pension and the rest went towards my estate.....basically none of it came to me - which i did expect.

The OR told me that all car expenses BEFORE bankruptcy would go to my estate and all claims AFTER bankruptcy would be mine.

I would like to fill in the forms to claim back the additional amounts of car expenses from the government for the period April 07 to April 08....I am unsure wether this would come to me....I would not be very happy if i filled in the forms and they just kept it all as before.......my car needs some tlc and i need the money basically......I dont know whether to include a covering letter with the completed form saying that i am discharged....perhaps i would only be eligible to the amount from August 07 - or maybe i am not eligible for any of it as I was only discharged two months ago - but the OR stated back then that all expenses after bankruptcy would come to me.....I am quite confused and do not want to do or say the worng thing that might hinder me receiving this....

Apologies for length of post.....i would be most grateful if anybody else has had any experience along these lines....

    Why dont you give your ORs office a call and ask, they can at least tell you one way or the other.

    You are very welcome you dont even have to say it is you, just a general enquiry and see what they say, at least you will then know the reply. which I dont think any of us can give you 100 per cent, I know I cannot.

    I see that you are very recently bankrupt - sorry to see that - however, I dont know whether this helps - for me personally, bankruptcy - which initially had me in a dreadful state was not the terrible situation that i thought it might be......you will be absolutely fine.

  • Hi there

    All you need do is telephone your tax office and ask for the forms - you can back claim three years - When I claimed just over a year ago it was 40p so you will be able to claim 5p a mile over the past three years from the inland revenue.

  • Does this mean anyone who travels for work can calim back the extra that their company does not pay??
    So if company pays 32p I can claim back the extra 8p?

    My Hubbie usually claims back about 400 miles a month!! (thats not including his commute obviously just when he travels for them during the day/night) and I am sure he doesnt get the full 40p..

    If he no longer has his expense forms how can he prove the last 3 years? Does anyone know that? He should have a years worth I am hoping so :) But wht about previous years should it be on his End of year tax thingy? P60??

    I posted a reply and it `got lost` so hope that this does not come up twice.

    Each month I receive a kind of wage slip and it lists all the work that i have done and the fees paid for each job - it also lists mileage - so what i would do is divide the amount that i was paid in mileage by 30p (which my employers pay me) and i will get the total amount of miles that i did.....Anybody who claims motor expenses from their company is entitled to the extra amount to 40p from the government.

    Could your husband write to his employers asking for back dated info on how many miles he has done.......Or perhaps if his ONLY expense is milegage, he could look at his p60 to see what he earned tax deductable and the outstanding amount that he received would be the mileage and divide the whole amount by 32p to see how many miles - then times it by 8p to get the amount (the form from the inland revenue is really easy to fill in).

    Or, perhaps you could submit an estimate - if you feel that he does 400 a month because i am sure that the inland revenue would check it with your employers before telling you and if you have submitted the wrong amount they would ammend it....it seems as though you would be entitled to around 384 a year - over three years it is well over £1000 so well worth doing.

    You claim it for the period of the financial year April to April.
