Gross Misconduct-Please Help.

You have been "charged" with doing something which your company regards as gross misconduct. There will be guidelines as to the penalties for this one being instant dismissal usually.
All I can suggest you do is throw yourself at the mercy of your employers and hope they decide to act with some leniency.
It is not in the slightest unfair if they do decide to dismiss you.
You gambled and lost - possibly your job.0 -
a friend of mine recently had a case of gross misconduct against her and she took a union rep to the meetings with her..she said they were invaluable and definatley saved her job, She had been suffering from stress which caused her to make the mistakes she made and the rep explained all mitigating circumstances to her employers and exploited her employers failings with their "duty of care" to her. Instead of being dismissed she received a written warning. If possible you should get a third party to go with you to the hearing and tell your employers everything that is going on in your life that may have contributed to you making the decisions that you did.0

Sales bonus- I get nothing until the case completes. However At the moment even when that happens I still get nothing because I am rated and graded as an underperformer and get nothing except for my basic.
So there wasn't even a financial incentive for me. It was all down to pressure and misjuddgement.
One way and another it sounds as if a career change might be a good idea.0 -
peterbancroft, you have done something which you KNEW was wrong. You cannot therefore rely on the fact that others are doing it, because the company may very well investigate them because of what you have said, and if they find evidence, invite to disciplinary. The most potent evidence will be the customers', and they are denying that you discussed signing declarations and submitting. You will not overcome that evidence by saying that they have not recalled the situation correctly.
I cannot see a way out for you, to be honest. Time for a career change, perhaps?0
