Totally agree with Kudox here. Please yourself what you do.I don't know why you are bothering asking as you've already made up your mind. How about leaving the country and not coming back as an option?

Well, I think you should definately be ashamed of yourself.

You applied for the loan and mortgage so grow up and take responsiblity for it. Pathetic.

Yes but aren't the lenders also culpable for agreeing a secured loan based on the value of my house, and relying on HPI to get their money back? I'm not denying I am responsible for the mess I'm in, only looking for the best way out!

"It also sounds like you applied for the loan fraudulently by telling the lender it was for home improvements, which would ultimately increase the value of your property,"

In reply to this I'll say that the lender was comfortable with 'debt consolidation' as the main purpose of the loan, and because they offered me so much more in one go, I took it! The lender ought not to have offered me extra and should instead have stayed at home. I never lied to any lender or bank about my financial position, just when people were throwing money at me I took it. And I was a fool. I now owe more on my home here in the UK than my home is worth. DESPTE genuinely using the loan for home improvements.

"As for the lenders having a claim on foreign assets, then perhaps it wasn't such a good idea to post this type of information in the public domain, clearly stating that the 140K you have stashed in a foreign bank account was funded 100% by the loan secured on your UK property that you fraudulently applied for?"

Nothing is as simple as you think. You have written me off as a deranged tax-avoider but I can assure you I am nothing of the sort.

I came here for help, but all you can do is try to shoot me down in flames. Perhaps I should have not come here!

I still don't see how my position on my own debts insults any body

You have the means to pay 250K of the 264K debt back.
The other 14K could be comfortably taken care of after that.

Instead you're looking to run away from your problems.
    Grow up and take responsibility.
  • Anjuna,

I think the problem with this lies with how you have put this across. Your post is entitled "Doing a runner" and it seems to me from your posts that you are only interested in the answers that would indicate whether you could get arrested for not paying your debts.

The insult to many people on this board is that you have the means to pay off a huge chunk of your debt, clear the small remainder, and then start afresh. yet your posts seem to indicate that that isn't what you want. People on this board are very fair. Try posting this on other parts of this forum and see the reaction you get. Folk on here have 2 or 3 jobs to pay off their debts, you have the money but want to run away from your responsibilities. I find that an insult myself.

Again, to me it seems that you want one of us to say that yes, default and run off to India, the mortgage people can't touch you and you can forget about your debt. Your first post clearly states that you want to know can you be arrested and can you be traced.

No ones writing you off as anything. People are responding the information you are providing on an open and public forum. What did you expect? A pat on the back and a "there there, off you go, default, run away to India and forget all about the big debt". Forget it. This forum will help anyone who has difficulties who wants to face up to their problems and very little patience for those who don't.

Your posts do not indicate a desire to do this.

I don't actually. I can only repatriate £50k from India at the most which wouldn't make a dent in my total debt,

I thought that's what I was doing (or trying to do!) by posting on this forum. I didn't realise I would be villified for my circumstances by others. I know I have made a mess of things financially but haven't we all when it comes down to it? Otherwise what's the point of trying to share your experiences and trying to get help from people more knowledgeable than you?

    Kind regards

You also have a house, which you say is worth £200k, sell it and repatriate the money = £250K

and stop trolling, you're no good at it.

I do not know which forum you should be posting on - I dont know any site that advises on how to commit criminal offenses (fraud) and get away with it.

Karma - what comes around, goes around and I am sure that no matter whether in the UK or India, someday, somehow you will get everything you truly deserve.

Neither do I honey. I am not looling to do anything illegal. I have committed no fraud. I am only thinking of the best way to 'get out of debt'. Being a debtor is not a crime you know, at least not in this country! There is no 'Debtors Gaol' anymore, or are you suggesting that there should be?

I'm sure I will too honey, but remenber the law of 3*3. If you wish bad on your fellow human being, you will recieve this (karma) back on you 3 times three.

I personally do not wish bad on anyone, and completely agree with people who have chosen to repay their debts rather that 'do a runner' as I have, and am completely in awe of them. I did not mean to cause offence by the virtue of my own circumstances, but circumstances be.

    3x3 let it be!

  • Theoretically, you could sell that house - and use the excess off to pay the balance after sale, thus rendering you legitimate again.

As an Indian woman (presumably on her own). Do you really want to go back to India to face what could be considerable consequences for lax morality (as you called it).

I don't really give a flying hoot-toot about your morals, or lack of them - and I don't think anyone who has been in-up-to their-necks can honestly say that the thought of just running away has never entered their minds either. It's not about morals, it's about what is logical to do, and sensible.

India has a large British influence, I'm honestly not sure whether you'd be committing ANOTHER offence by deliberately running (ie: evasion of something or other - or fraud).
