Car Repossesion

( My husband posted this in the loan board, but I feel he would get more support and help from you guys here, do any of you have good advice for him? Thanks )

I am using my wifes log in on here because I dont have one of my own yet. I am just after a bit of advice if anyone can help.

I know this should have been dealt with a long time ago but just kept burying my head in the sand hoping it would go away but here goes.

In 2004 I bought a brand new car from a main dealer and everything was fine until a couple of months later. I ended up losing my job because of my g/f at the time and then couldnt keep up the payments on the car. I got letters from the Finance company (Blackhorse) asking me to pay the payments etc, but I culdnt afford them. Eventually, one day I was at work ( I managed to get a crap job with crap pay) my car disappeared. I phoned up the company who said they had taken the car and that it was going to be sold at auction. Being young then, I thought fine, thatl be that. Then I got a letter saying that I owed the balance which was around £6000 (the car was £12000ish with interest, so they got around £6000 at the auction. This I was not pleased with. I have since refused to answer any calls or letters from the various debt companiesthis has been passed to. How can you be charged for something that you havent got? If I still had the car then fair enough.
Also I was only 19 at the time so I dont really know if I have been misled by things I have been told eg. PPI

On another note does anyone know what you can do if a company refuses to accept your offer of payment. Another debt I have called me and wanted me to make 4 payments of extravagant amounts which i could nowhere near afford, I offered them £20 a week and they told me it wasnt good enough so i Hung up and never answered them again.

Any help would be greatly appreciated

    Have a root around the nationaldebtline.co.uk websire and see if the answer is there, if not you might do well to get in touch with one of these organisations

    They should be able to help you with negotiations with these companies.

    I suspect you will have to pay the £6k as that covers the rst of the amount they loaned you although you could try to request your Agreement under the Consumer Credit Act (there are letters on the NDL website I posted about above) but I am not sure if this applies to HP loans.

    Sorry I can't be of more use but if nothing else I have bumped it for someone who knows more than me!!!

  • unfortunately you are responsible for the 6k shortfall. i would suggest making an offer of payment to them. it won't go away i'm afraid. They won't allowances for you being young either.

    Also have a look at when the last payment you made towards that other debt was. If you have not made a payment towards a debt or acknowledged it in writing, the debt may be statute barred after 6 years (5 in Scotland).

    HI try the following website it is very good and have people who are very upto date with car finance agreements. I used it and had my agreement made unenforceable due to a number of factors.
