Me and DH are waiting for our info pack but wondered if u could answer a question for us?
We have included joint debts and debts in our own name in our DMP. What happens if one of us dies during the dmp? Or what happens if we seperate/divorce?

Hi there.
Joint debts are classed as 'joint and several liability'. This means that you both owe 100% of the balance. If one of you dies, the other becomes responsible for the full remaining amount.
In the case of debts in your sole name, only you are liable. So if you were to pass away your partner would not be held responsible for paying (and vice versa). The creditor would have to make claim against the estate of the person that has died.
If you split up on a DMP, you would need to call us for advice. Generally we would do a budget just based on your costs and debts as well as a contribution towards the joint debts, and the same for your partner if they still wanted help from us.

I am in the process of setting up a DMP with CCCS and have also applied for a Co-Operative Bank Account. My husband gets paid next week and so I am getting a bit concerned that the Co-Op account won't have been set up yet. I have a Natwest Account that has no overdraft, however, I am worried that one of my creditors may be linked to Natwest. Can someone tell me if any of the following are linked to Natwest or the Co-Op?
HSBC
Barclaycard
MBNA - Virgin
MBNA - BT
Zopa
Next
Littlewoods
If not, where would I be able to find this out?

Hi there.
Only credit debts that are specifically with Natwest offset funds from your Natwest account. Your fine with the debts you have above.

Hi MM.
If you've just come off a DMP then you won't need to send statements to us, a we should already hold all the information of your debts (the pack you have received is a standard pack sent to all new DMP clients).
What you will need to do is get an up to date balance from each creditor and either phone us or write to us with this information. Once we have this we can transfer the information for your debts from the old DMP (such as account numbers etc.) and then you should be good to go!

Hi CCCS rep, I am on a DMP with you and so far everything has been great (Its only been 2 months). You guys are so good at putting my mind at rest!
BUT-I have just hit a massive snag.
1: A DD to my phone bounced a few weeks ago, so I paid my bill with a different account over the phone, but my DD was then taken again and I have been charged £25 + £5 a day by my bank for going over my limit. My phone company have agreed to return the payment but my bank wont budge and have said they will charge me the £5 a day regardless, because the £25 fee has taken me over the limit anyway!!
2: My car is due its MOT in April, and the money I am now losing due to the above has left me with no budget for the MOT, especially if it fails.
Is there any chance that I could pay a reduced amount/have a payment holiday for 1 month while I straighten this mess out?

Hi Bigbopper.
If you give Client Support a call (let me know if you haven't got the number) they should be able to do something for you. When you have a minor blip or an unexpected cost it can throw everything out the window! Normally in such a case, you should be able to reduce your DMP payment or miss a month to get sorted. Yes it is following advice on here, contacted CCCS and following their proposals. So did I misunderstand the 30 days then?
Blackhorse: is there anything I can do? The idea is to get out of debt not create more. At least when I was robbing peter to pay paul this particular loan was going down every month - so I am a bit dissalusioned and confused.

The 30 day rule is set out to give somone breathing space when they first get into financial difficulty. In theory, creditors should stop taking action or contact you whilst you seek advice from someone such as CCCS for advice.

Once you've had the advice, the creditors have the ability to contact you again should they want to. If you offer a reduced payment to the creditors through a DMP or directly yourself, the creditor doesn't have to accept the proposal, and they don't have to stop interest and charges I'm afraid.
Was the advice to pay £1 a month directly to the creditors because there was no money left over to pay your creditors, or are you making £1 payments to each creditor until you start a DMP with ourselves?

over the past few years i recieved letters from mackenzie hall who say i owe over 7000 to lowell portfolio 1 limited. i phoned them last year and was really worried about the amount even tho i didnt know who the debt was with, anyhow last march i set up a direct debit to pay them 25 pounds a month till the year 2034. when i spoke to them i asked for a copy of the original agreement and as i have still not recieved it after a year i decided to stop the direct debit. 2 weeks after doing so i recieved a letter from them, a reduced settlement offer of 5700. but i noticed the original amount even tho i have been paying them for a year is still the same amount. i dont know who the debt is with but i am really worried cos i am expecting a baby and i have these letters keep coming in saying they want payment. i really dont know what to do ..please help. and this debt is not on my credit file.0

I am new to this, like many my loans and credit cards were all in hand until my partner lost her job, I hae a child to support etc.
I spoke with my IFA who referred me to Eurodebt. After speaking with one of their advisors they seemed ideal, however I could not afford their fees. After looking on here it looks like I have done the right thing so I have been in contact with CCCS & Payplan.
When the guy from Eurodebt called to see if I had made a decision he advised that CCCS will very rarely push to stop interest on debts, as they have a close link with the banks which fund them. I called today and asked if this was true. I did not really get a response, I was advised they will ask but it depends on the debt and banks are generally not that willing. I have already filled in my details so they will know who my debts were with etc.
Payplan seem very proactive, they called me earlier this evening and seemed optimistic much like Eurodebt. They advised that looking at my creditors MBNA, HSBC & Tesco Finance that they would not see it being a problem freezing interest with these creditors, which was the same response I got from Eurodebt.
I advised both CCCS & Paypan that I have a rented property which I am only able to sell in July 2012. Paylan advised they would set me up on a DMP with a program which would offer a monthly payment with the intention to settle debts in 2012, of which they advised they would be able to negotiate a good discount.
I know these are both charitable companies that do not charge a fee, however I wanted some additional advice from CCCS & anyone that have used Payplan.
I have read a few articles who advised clients were not happy with Payplan, however I don't understand why they would try to be competitive as they offer a free service?
All advice would be appreciated as I don't want to get on a plan and find out that I may have made the wrong choice, it's something I need to get right promptly.

I am due start a DMP on 1st April with yourselves. So far I have sent token payments to my creditors with my DMP notification letter and 3 out of 5 have been in touch accepting. One of these is Northern Rock they have accepted the DMP for 6 months and have stated in the ltr to me the first payment is due immediately. As they will not get my first payment via yourselves until 25th April do I need to pay this or will a token payment suffice. If a token payment is okay what would be correct amount to send. Is the normal to only accept for 6 months? my other creditors have not stated any timescale.
