I have just completed the CCCS Debt remedy online and it has recommended a DMP with a payment of £100. My debt is £15000 over 6 creditors, is this level of payment likely to be accepted??
How long will it take for the welcome pack to come?
Also I have 2 creditors which are due for monthly payments this week and with 1 being £85 and the other £40 I just cant pay them, what should I do?? I really would rather go into a DMP before I default any payment, I havent missed any with any of them yet! or does this not even matter as they will default me once I am on DMP?
Sorry for all the questions but I am really nervous about going down this route, but i can't go on the way i am, meeting the minimum payments but with no light at the end of the tunnel as the interest eats up my payment completely!

Your welcome pack should be will you shortly.
In the meantime, you need to use the ‘Notification of DMP’ letter to write to each of your creditors with a token offer of payment until your plan is set up.
This would have been included in your Debt Remedy advice booklet.
If you are making reduced payments to your creditors then you can still receive default notices, even when you are on a DMP.
If you have any other questions regarding your DMP, or you do not receive your welcome pack for any reason, then you can call our Debt Remedy support team.
You should have a telephone number for Debt Remedy, but if not, let us know and we will send you a PM.

Hi
I’ve been on a DMP with CCCS for 18 months and have paid over £12000. Trouble is I owe as much or more now as when I started. The credit card companies just keep on piling on interest and charges. I have decided to go down the solicitor route to see if any of the debt can be cancelled. I would not have taken this decision if there was light at the end ot the tunnel but they just keep bumping up the debt. I will let you all know how I get on.

Have you had a review of your plan recently?
Unfortunately, the creditors do not have to stop interest and charges. It is entirely at their discretion. However, they normally agree to stop when you are on a plan and you are making regular payments and there is no high expenditure in your budget.

I am currently on a self-managed DMP with the CCCS and one of my creditors has advised they will not put me forward for a stop on my interest and charges on my credit card account as I spend too much on basic needs. The budget shows I am only spending the recommended guideline amounts from BBA.
I spoke to a CCCS advisor by phone today as I feel my creditor is not taking the required "sympathetic" view and she advised I can raise an FSA complaint with my creditor. She also mentioned that should be adhering to a certain FSA principle.
I can't remember which one it was titled and I have tried to find a link on FSA's website so I am able to quote the certain principle in my letter of complaint but I cannot find it.
Are you able to advise me which of the principles it is? and/or provide a link to the principles set out by the FSA to help people in financial difficulty?

I’m not sure of the exact quote you are looking for, but I have found one that relates to the Banking Code set out by the British Banking Association “We will deal quickly and sympathetically with things that go wrong and consider all cases of financial difficulty sympathetically and positively”
I have also added a link to the Credit Services Association (CSA) that points out its members should “Handle debt cases in a fair and reasonable manner”. http://www.csa-uk.com/csa/what-we-do.php

Does that mean that they will be able to enforce no matter what? I read elsewhere that it was very unlikely for the Court to grant an enforcement order after so long, as the DCA would have to justify why they had taken no action for so long. I have been on the electoral role all those years, they could have approached me at any time but they picked now and I am sure it is either because they can see I am now paying off my debts or because my name now comes up on a Companies House search so they know that the threat of bankruptcy is a scary one. If they apply to the Court for enforcement is it automatic or can I attend and argue against?

As far as I am aware the court would be able to enforce the debt. As this debt is a CCJ already the limitations act would not apply. A debt management plan would have an effect on your credit file, as it would show that you have arrangements in place for your debts and possible default notices and CCJ’s. If your partner has debts with the bank where she works then we advise that she makes her HR department aware of her situation.

hi i was looking for some advice for my friend and her husband. they have been sent a bill for £3500 for nursery bills from 6 years ago. my friends husband cancelled the direct debit on his card but forgot to transfer it to his wife's. he refuses to pay but they have now recieved a letter from the court regarding this money. can the council wait this long to bill them and if so can they pay it back in instalments. thank you0

Also, what effect does our mortgage have on a possible dmp. Our mortgage is with NR and is, in effect, a combination of 5 secured loans. Will they be counted as creditors in a dmp or just disregarded except for inclusion in outgoings?

Was there any type of consumer credit agreement signed? If so, then the debt maybe statute barred if no payments have been made within 6 years therefore you could defend the claim.
If it is not a regulated agreement then as far as I am aware you would have to come to an arrangement over the outstanding debt. I would recommend that you contact Consumer Direct they are part of the OFT and they will be able to give you more information on agreements. Their contact number is 08454 04 05 06.

Hi JoJoB,
The amount you have in for food is fine for a family of your size. If the loans are secured against you home, then payplan will treat these as a priority and include them in your main budget. It is only when the debts are unsecured that they become a non priority.
