    Thanks Sarah. Our DMP is with Payplan. The sort of figures i am talking about are the creditors that are owed amounts such as £150, £80, £350, of a total debt of £34000. Just thought it would help so that the larger creditors would get all my disposable income, whilst it will give us some "light at the end of the tunnel".

    I have already challenged Welcome regarding reclaiming of PPI and I received a cheque from them for £393.04 which refers to my original agreeement. They did not agree to repay anything on the top up/2nd agreement. This morning I received a letter from them which is as follows:

    I write further to your letter and please accept my apologies for they delay in my reply.

    We are now in a position to cancel your existing loan account and replace this with a new account, which will not contain any additional insurances or the associated interest. We are also in a position to refund the payments made towards the PPI policy that you have already made.

    This new loan agreement will effectively be backdated to the start date of your existing loan account. This will allow us to place you back into the position you would have been ins, should you not have purchased the additional insurance products.

    Therefore, the new loan documentation will reflect the terms and conditions of the original loan, but without the insurance products or associated interest. For example, the loan term, amount borrowed and acceptance fee (where applicable) noted in the new documents will remain unchanged. Any charges such as the acceptance fee shall only be charged once. However, they will need to be shown in the new legal documentation.

    Any payments that you have made towards the original loan shall be credited towards the new agreement. This means that the number of payments you have already made shall reduce the balance on your new account.

    In order to complete this process, I have arranged for our Insurance Cancellations team to issue new paperwork direct to your home address, as the alterations to the agreement will require replacement signatures and your acceptance to the new terms and conditions of the loan.

    I do note that you may wish to receive specific refund figures at this stage. However, this will depend entirely on how many future payments you make towards the loan agreement. Therefore, I am unable to provide you with a specific refund figure until this process has been completed.

    Should you not receive the relevant paperwork, please contact myself at the above address. I shall then arrange for the paperwork to be re-issued to you accordingly.

    Should we not receive the signed paperwork from you within four weeks from the date of issue, we shall close the complaint accordingly and assume that the mater is resolved.

    Should you remain dissatisfied with our final response, you can escalate your complaint to the Financial Ombudsman Service within six months of the date stated on our final response.

    I have also listed below for you further details of payments made on my account and what the figures show on the agreeement. This now has me totally baffled. Does their new offer now mean that the total charge for credit of £3773.62 is now going to be written off. If so will this mean that added together with the amounts I have paid, that this should clear the debt??????? I'm truly grateful for any advice/help you can offer.

    Hi again,

    I called CCCS a few weeks ago and they put my mind at ease so much (they made me feel so much better about things), but they can't give me a telephone appointment until July 15th. Their advice was to write to all my creditors and explain what's going on and that I'm considering a DMP and to include a token payment, despite having made agreements with some. Now I'm getting constant phone calls and letters and believe me, it's scaring the hell out of me!! :o There are all sorts of things going through my mind...

    Will they turn up on my doorstep? Will they put me into court? Can all this happen before my appointment?

    About a year ago my wife put her finances into the hands of CCCS to whom she pays a monthly sum.

    Certain creditors are now 'phoning her up to 20 times per day from morning to evening, at weekends and on her home and work telephone numbers. They have also sent text messages to our landline!

    We have told them over and over and over again that the matter is in the hands of CCCS but they simply say that they do not deal with credit agencies and that the calls will continue.

    The worst offenders are Aqua and HSBC.

    My wife has reported the matter to CCCS and Trading Standards but the silence has been deafening!

    These calls are a nuisance and an embarrassment. What can we do to stop them?

    These creditors should not be harassing you.
    I have attached a sample letter you can use asking them to stop contacting you by phone and make future contact with you in writing only. Send this letter to your creditors and keep a copy for yourself.

    To whom it may concern

    Dear Sir/Madam

    I am writing to ask that you no longer contact me by telephone as your calls are causing me considerable stress due to the frequency, and that they are being made at inappropriate times. Please remove my telephone number from your database and send all future communication in writing to my home address.

    I have provided the most recent copy of my income and expenditure to make you aware of my current financial situation. I will continue to make my payment of x on the x of every month and will keep you informed of any changes in my circumstances as I am keen to resolve this issue as soon as possible.

    I understand that following this request if you continue to call I can contact the Office of Fair Trading to make a formal complaint.

    Please confirm in writing that your records have been amended.

    Hi juliesmiles and thank you for your message

    As far as I can see,it looks as though they are rewriting the loan under the same terms as the original loan, but minus the PPI and the interest on the PPI and less any money you have already paid.
    I do not think the total charge for credit is being written off, but I would contact them directly if you need further clarification on this as they should be able to give you a complete breakdown of money paid and how much is now owed.

    Normally, when your creditors hear you are waiting for an appointment they put things on hold until you have had your appointment with us.

    The main thing is to keep paying them a regular monthly token payment until your appointment with us.
    If they send a collector round to your property, they have no special powers. They are employed by the creditor to try and negotiate payments.
    Just stick to an amount you can realistically afford.
    Do not be pressured into paying more if you cannot afford it.

    If you do get a county court judgment, then ring our client support team and let them know.
    You normally do not need to go to court. It is all paperwork.
    If you need any help at all before your appointment, you can ring our client support team for further advice.

    hi
    I have unsecured and am having to use further borrowing to keep up with minimum payments, I am considering a DMP as way of getting out of this cycle and become debt free. I have some concerns though:
    1. my husband has always been good at paying off all his debt and he only has one credit card with a small balance which he is about to pay off if I take a DMP for the debt thats in my name will it negatively affect his credit history? Similarly if I have a credit card with the same company as he does will he have to give up his card, he uses a cashback card that he pays off in full every month.
    2. I have a mortgage with the halifax and a credit card with them will this have any implications? My mortage fixed deal has just ended should I secure another deal before starting a dmp? I was told that halifax mortgages are seperate from the credit card part of the company so this may not be an issue.

    Hi, I'm looking for some advice from a CCCS counsellor. I have an appointment with a debt counsellor next week and am trying to pull together all details of my finances. Here's my problem...

    I took out two credit cards in June 2006. One from Marks & Spencer and one from Tesco. I didn't spend responsibly and both accounts got passed to Moorcroft debt recovery. I made irregular payments to both of these accounts with the last payment in Oct 2008. I phoned Moorcroft yesterday (with reference numbers) to find out what my outstanding balance was. After being on hold a couple of times, i was told that both of these accounts had been passed back to the original companies and I would need to contact them.

    I phoned M&S and spoke to three different people. They told me that they had no record of my account and no record of me ever having any credit with them. It's the same story with Tesco.

    I'm trying to sort my debts out and find out what I owe but I have never heard of debts and files just disappearing!

    Any ideas or suggestions?
