    hi,
i have a dmp with cccs, one of my debts is the halifax credit card and it has piled so much interest on in 3 years i have paid £1200 roughly but it says ive only paid £150. My debt councellor told me today to go online to the bba and to check the banking code 14 and 15 and that i could write a letter of complaint to them cause they have signed a contract saying that anyone in debt has to pay 1% of their debt and im payin 2%, and that they will only charge you 1% interest for 18 months then they will sell it on to a debt collector interest free. But having looked at the bba the halifax is not on the list of banks and also it is a credit card not a bank i owe the money to.

    Hi jarbie,

Even if you are on a DMP a bank may be willing to accept a smaller payment from you, but they do not have to accept a reduced payment just because a payment is being made. If they are unhappy with what you are paying they generally do tend to continue with interest charges.

The best thing for you to do is contact our Client Support line and ask them to arrange a review for you to discuss the interest. If the charges are likely to continue it may be that you have to consider another solution to the debts.

You could try to contact the Halifax and see if there is a reason that they are continuing to charge you even though you are paying a good DMP payment to them?

    I hope this helps.

    Regards,
    Amanda

A Q for the new DRO

Hi just a Q. I have just started a DMP with CCCS with my husband, but my total debt personally to me are £10K so would this be the best option for me, as I only earn about £100 a month self employed. The car is in Husbands name so I dont own the car and have no assets such as a house, savings etc..

Will this effect my business even though i have no money in it, will it effect my current bank account as non of my debts are with my bank and i have had good standing with them.
    Hi Vanilladelia,

It sounds like a DRO could be an option for you. The main qualifying points are:
    - You can not have more than 15K in qualifying debts
    - You can not have more than £50 per month surplus income
    - You can not have more than £300 worth of assets
    - You can not own a home

Of course it is not quite that simple but those are the main points.

If you are a sole trader then there should be no impact to your self employed status. The only point around this that is worth making is: if your business were to take off within the 12 month moratorium period then the DRO could be revoked. You more or less have to be able, as far as you can, to guarantee that your circumstances will not change dramatically.

The Official Receiver (OR) will not freeze your bank account; however, you would have to check with your bank on their policies regarding DRO’s.

If you would like a definite answer then you would have to come through to us for another appointment. We would review your situation, create a new budget and split up your debts.

    Regards,
    Amanda

I went thru the debt remedy ealier this week and i am now ready to put it into action as i am back at work tomorrow. My finances have needed looking at for sometime as me and my wife have been struggling for a while. With work being on hold for nearly a month was the catalyst to getting the situation sorted.

The debt remedy suggested a IVA or a DMP, i would rather go for the DMP and arrange it through you. I will start the application now. I have set up a basic bank account, is there anything else i should do in the mean time?

Not in the mean time no. Once you accept the DMP you will get a pack sent out to you in the post which will contain template letters to inform your creditors that a DMP is being set up, and the information needed for you to send to us to get the ball rolling.

    Good luck!
    Matthew.

Thanks for your reply. Just going through the debt remedy was a help in itself.
  • Hi, i could do with some advice please, after weeks of dreading opening the post, i have finally plucked up the courage to go through all the letters. I need to ring my creditors to get the exact amount owing on each account and i'm worried that they are going to demand i make a payment over the phone or ask for a date when i will make a payment (which i don't want to do yet until i've got more advice from cccs).

    Hi Kate,

If you prefer not to speak to the creditors directly you could opt to get a copy of your credit file instead. For a small fee (or in some cases you can get a free months trial) you can get all the information of balances in one place. You can get your credit file from any of the following organisations:

    www.experian.co.uk
    www.equifax.co.uk
    www.callcredit.co.uk

Or if you do ring up, just say you are in the process of getting some help with your finances and will be in touch soon to discuss the situation further, but at this time you cannot commit to anything more than a token payment until you've had advice.

    Hope this helps,
    Matthew.

Hi we have dmp with CCCS and all has been going OK.

Recently we noticed that Barclaycard has started to charge us interest again. Not a huge amount, certainly not the full rate but until a few months ago no interest was charged on our balance.

Is this normal behaviour for creditors?

    Thanks.

The Notification of a DMP letter will be sent to you in the post after you've selected the DMP on Debt Remedy. We will also send you out the forms we need you complete to set up the DMP. This is normally sent out about a week after you completed Debt Remedy.

    Hope this helps,
    Matthew
Thanks Matthew, just got in from work & notification letter waiting for me. I wondered if you can tell me how I know when my DMP will start, it doesnt say on the letter, can I request for it to start a particular month or does it have to start in May?

The reason i ask is that pay day here is 15th of the month, we have paid all March's debts up to date from march's pay so the DMP if it were to start on 1st May would have to be paid from Aprils wages & I was hoping to have a month with nothing to pay out so I can put something away for emergencies before starting the DMP

    Thanks

  • I currently have a Land Rover as my hobby (working on it in the garage is as much a hobby as driving it off road!). It also gets used as a tow car when we take Scouts out. The mandatory costs per year (tax, mot etc) only come to a maximum of £500 a year. I do the maintenance myself, and can often get parts second hand for cheap money or swaps for current parts I have. The Landy is not my main commuting car.

My wife and I are looking at a DMP (she has already been posting on her re that, thanks already for the advice!), where would I stand with the Land Rover? I do not want to get rid of her but wonder how she would be seen if we're entering into a DMP.

    Any advice gratefully received!
