Hello I have agreed a new payment with all my creditors apart from hsbc. They have said I have to get cccs to make an offer on my behalf for them to accept it.
Is it possible for yourselves to make an offer with out it affecting my other agreements?
Thanks Craig
Unfortunately not; if we were to get involved we would put all of your creditors on a DMP.
If all of your creditors are happy with your reduced offer of payment, and you only have one creditor that is making things a bit difficult then we would advise you to keep paying them your offer even if they are unhappy. You could try sending a copy of your budget to them to see if that makes a difference.
If they will not accept your offer eventually they will issue a default notice and pass your debt to a specialised collector. This will give you another opportunity to negotiate and have them accept your available income.
I hope this helps.

Your first payment is supposed to be made by trans-cash in the Post Office. For your second payment you can ring the Client Support number provided in your welcome pack for the Standing Order details.

hi were on month 2 of our dmp with you and we are getting hassled by calders/barclaycard day/night,they keep saying they cant set up our payment plan on the 3 cards we have with them until they recieve the payment proposal from yourselves, ive contacted you about this before and this has now been sent twice to them but they keep saying they havent recieved it just the letters of authority, theyve said the payments you have made to them will be accepted but they need payment proposals to set it up,they said you can contact them over the phone to do this, would this be possible as i know how busy cccs are at the moment?
You will need to ring the Client Support number and ask them to send out another proposal. Just explain the situation to the advisor and they may be able to advise when the other proposals were sent.

Thanks amanda
I sent a letter offering them £400 extra and said that was the final offer i could make to them and if they could not accept this then i would have to use money for another creditor. I also said that if they could not accept my offer then I would have to pay them £15 per month as money for them would have to be used for other creditors and i could not afford any more money from my monthly salary - is this ok?
That is fine. Sometimes you have to go back and forth with a creditor before you can reach an agreement.

im am trying to get my head around my debt problem, not sure which way to turn, looking at all my options DMP seems to be the best one in my situation, my only problem at the moment is that i have just changed jobs and i wont get my first pay until april so i have about 6 weeks to go so i cant even work out what my income will be , i can guess but it wont be an accurate amount, i have tried to speak to some of my creditors and some are understanding and others have been down right rude, whats bothering me the most is the thought of having possible court action in the near future as i have buried my head in the sand (as you do) my husband has been very supportive and the debt is mine not his, we are struggling as he has had his hours cut to basic , so he brings home half of what he used to , any help or suggestions would be most appreciated
It is a bit difficult to know where to start when you are in the middle of such big changes.
All you can do is to keep your creditors informed and make token payments to them if you are able. If they decide to apply for a CCJ in the next 6 weeks or so then you just have to complete the forms and make an offer of payment; this may have to be a conservative estimate.
Even if you do not get your first wage till April we can start the ball rolling so to speak. You can take some advice now and a DMP is appropriate for you, then you could be setting everything up prior to your first wage.

dont_want_to_be_in_debt wrote: »Can anyone help. We are on the second month of our DMP and are doing well. The problem is that our income varies wildly. Sometimes with £1500 difference each month. What we want to do is to keep some money in our account from the good months to keep us going in the bad months. The balance we have over this amount would be paid straight to the cccs to distribute to creditors. We do not want to save money just not have to change our agreement every month. We have been told that creditors will not accept savings any help or advice please?
As your income varies every month then the income listed on your budget completed with us should have been somewhere in the middle of the fluctuations. If you have a really good month then you should put some money away to cover the slower times. This will mean that you are usually always able to meet your DMP payment. This is not classed as savings as you are balancing out your income.
If you have quite a few ‘good’ months and have excess in your budgeting account then you can make a one off payment to the DMP.
I hope this helps.

Hi
My hubby is in dmp with cccs for last three years and in process of starting to claim back ppi. Does he need to let cccs know before he starts. It would be large sums involved that he is hoping if claimed back would be paid towards clearing his debt. Just a bit concerned about mucking up his dmp.Yearly Grocery Budget - £100.77/ £3500. Hello all,
first off: thanks for having me..
This month I have recived two letters from Messrs Hall DCA's.
They stem from credit a card debt I aquired round 2002, I was really ill with mental health problems and am only just now starting to take control of my life again. So recalling all the old details is next to impossible.
The first letter from them asking me to contact them urgently regarding a "personal" matter. when looking up their name on google I found your board(thank goodness). Exactly a month later I recieved letter two..
This one demands full payment by noon of Feb 24th 09. I think I shot myself in the foot because I asked experien for a copy of my files after the first letter and the search must have linked all my address's.
I had fully intended to pay this but I've been on IB for some time and probably for the forseeable future, so wanted to wait till I could set up a payment plane I could afford. Plus the DCA has ramped up the ammount owed by 437 pounds, which seems a bit high for simple fee's.
Original debt = 475.52
M, Halls demand = 912.65
Can they do this?
I'm contacting CAB and CCCS tomorrow, rang them tonight but CCCS said they were so busy and to call again tomorrow.
In the meantime any comments would be of great help. and can anyone describe to me the kind of proof and how to make a SOA to present to the courts (if they go that far) or the DCA. please?
thanks for any replies in advance.
Roger.
Hi Roger,
As it has been quite a while since you have made payments to the credit card then I would assume that the £437 is interest, late payment fees, over limit fees, etc. You can ask the creditor to provide you with the details of the account by writing and making a written request. I have attached a copy of a template that will help you to do this:
ToWithout Prejudice
Dear Sirs
Ref …………………………………….
With reference to the above account:
Please will you send me a true copy of the original signed agreement together with an up to date statement of the account showing all transactions, including interest and charges, and a copy of any other document referred to in the agreement.
I understand I am entitled to this information under ss77-79 of The Consumer Credit Act (CCA) 1974.
I also understand that this information should be sent to me within 12 working days of you receiving this letter. The CCA states that creditors are unable to enforce an agreement until this request is complied with.
I am enclosing the £1:00 fee, payable under the Consumer Credit Act 1974, for each account.
Yours faithfully
When you are completing your income and expenditure you really need to follow a simple formula. Take your ‘priority’ expenses (rent, mortgage, household bills, travel, food, TV licence, etc.) and take these from your monthly income and what you are left with is what you can afford to pay to your creditors(credit cards, etc.).
We would be able to help you to do this and also to advise you on the court process. You can visit our online debt advice facility called Debt Remedy. Debt Remedy would assist you in completing a financial statement and you would be provided with tailored advice on the best way to deal with your situation. Click here to go directly to Debt Remedy.

jaynebryan96 wrote: »Hi, i have just posted on other site but desperate for some advice.
I was paying my council tax missed payments through Equita, but i forgot to pay Feb 09 payment.
This has now passed to a baliff. I received a letter from them on saturday stating the balance is £544 they baliff called yesterday and gave 7 days to pay but said the balance is £715.
I have sent Equita a letter (subject access request) by recorded delivery today asking for proof of monies owed and proof of court order etc.
What should i do now? Do i contact the baliff and tell him what i've done or wait??
I tried phoning Equita but as it has been passed to the baliff they wont speak to me they said i can only deal with him now.
What do i do, any help would be gratefully received.
Really what you need to try and do is to call the bailiff and make an arrangement to pay with them. The offer will have to be quite a good one and if accepted it is really important that you stick to the offer even if this means that you’re unsecured creditors get nothing but a £1 token payment for a few months.
If the bailiff will not accept your offer they may try to gain access to your property and ‘levy’ your goods. Basically what this means that if you do not give the bailiff what they want they will take the goods and sell them at auction. What ever you do – do not let the bailiff even put one foot inside your door. You are best just not to open the door tell them to contact you by phone.
If no arrangement can be met at all then the bailiff will send the debt back to the Council and they will probably apply for an Attachment of Income.
Although we normally do not advise you to borrow from family or friends, if you can do this it will be easier to pay them back than trying to negotiate with a Bailiff.

My partner is currently on a DMP of which should be cleared within 5 years. How long does the DMP stay on his record and how long before he would have a credit rating elligible to get a mortgage?
We currently have a mortgage but he fell into arrears and also has had a charging order against it, we're going to sell it soon to clear CCJ.
Will we ever be able to get another mortgage?
Anything that goes on your credit history will stay there for 6 years, so if your partner receives a default today then that will stay on his file for years from today.
You will be able to get a mortgage as it is secured lending; however, you may have to shop around and you may pay a premium on the interest rate offered.
I have attached a copy of a booklet that will give you a lot of information on your credit file and the information held.
