IQOR, CCA request and Payplan - any advice?

I sent a CCA request off to IQOR last week, along with a strongly worded letter about contacting me only in writing. I received a reply at the weekend - first, they've taken my phone numbers off their records but couldn't see why I was complaining about them phoning me despite me writing to them earlier about no phone calls. That's one result, at least :) They also confirmed that MBNA have had my latest payment and that's been taken off my balance.

The CCA request is "being dealt with separately" which I expected - they've got 10 more days.

My problem is they're being difficult about dealing with Payplan. They won't accept any contact with Payplan until I sign a form giving my permission - they're saying it's to do with the Data Protection Act. I've written to them twice stating that I'm on a DMP with Payplan but of course, haven't signed any letters as advised on here. I have a feeling they are after my signature! I think we're at an impasse here, as I don't intend to give them my signature unless they come up with a CCA. :confused:

Should I write to IQOR to tell them this, and if so can anyone suggest suitable wording of a letter? I'm hopeless at writing letters like this and I don't want to miss out anything important. Or should I leave contacting them until they've had their 12+2 days from the CCA request and see if they can come up with one? They'll be getting their first payment from Payplan before the 12+2 is up anyway so at least they can see I'm paying the amount Payplan have worked out.

    You can leave then to stew really. If Payplan have the correct payment details, then they can just pay them and IQOR can "like it" or "lump it".

    If you really feel the need to respond, then you could send something like the letter below.

    Dear Sir/Madam,

    RE: Account NO XXXXXXXX

    Thank you for your letter dated xx/xx/2008 the contents of which are noted.

    In your letter you make reference to requiring my signed authorisation /specimen signature** before you comply. I draw your attention to the fact that there is no requirement under the Data Protection Act for me to provide this.

    If it is for Data Protection purposes then i can happily supply you with documentation to substantiate my identity to you.

    However please note that to date you have happily sent statements and correspondence containing extensive sensitive private information to my address. I have to ask if you are concerned that you are corresponding with the correct person why has it taken so long to raise this?

    As you are aware, disclosing data without adequate checks of identity is contrary to the 7th principal of data protection, listed in schedule 1 of the Data protection Act 1998:

    7. Appropriate technical and organisational measures shall be taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.

    Furthermore, refusing to deal with my chosen representatives without good reason is contrary to the Office of Fair Trading's guidance on debt collection. As such it is considered unfair practice.

    I look forward to your cooperation with my legally nominated representatives.

    Thanks for the quick reply! I can adapt that slightly for them, if I do decide to write to them. As you say though, I can just leave them to stew for now anyway which I might just do. I will double check that Payplan have the reference number and payment details just to be sure.
