Please can anyone help me?
The first thing I would like to say is I do not receive all of my mail I have had my MP onto it but that is another story. I tell everyone that I do business with this and ask they either contact me by phone or email
in 2002 I cut up my credit cards I had one with Lloyds and one with the Halifax as well as a bank loan with the Lloyds.
I cut the cards up as I had split with my partner, we saw the bank manager and I said that I would have my DLA paid into the account to cover my cards and my loan. few months went by I started getting calls saying that I was behind on my payments and that I had not responded to any of their mail so they had put charges and interest plus late payment charges onto the account. I tried to sort it out with them (I would like to mention that the halifax were brilliant in this case.) but to no avail I could not even use the loan protection as I was on income support and not job seekers allowance I asked if I could cancel the protection and it feel on deaf ears (the same as everything else I tried to arrange with them).
I went on a debt management program and got myself a job and I offered to settle with them, but at what I thought was reasonable (the card had less than £2k on it when I cut it up when I went on the debt management program it had £2.5k on it. I askeds to speak to someone to arrange something and I was told I would have to put it in writing. I spoke to the people running the debt management for me who told me to send in a payment I was willing to offer with a covering letter explaining why I came to that figure and that this would be the final payment made to the account. I was advised that if the cashed it they were accepting the terms of the letter.
They cashed the cheque last September. In February I received a solicitors 7 day letter to which I replied to I told the gentleman on the other end of the phone exactly what was going on he asked me to hold (I was on my mobile to an 0870 number in the middle of the day) while he spoke to his suppervisor. He came back 15 minutes later and said I have been told to tell you not to worry it will quoshed, you may receive a few more letters but not to worry as they will stop.
2 weeks latter the phone calls started agian I was going through the same thing over and over again.
I wrote to their FMU I've faxed them Ive sent the information they requested countless times. Now I have got so fed up I have told them that the only way they will get any more money out of me is if a court orders me to pay. And when they fix up a date for the hearing I want them to inform me personally of when and where because I want to be there to show the courts just what they have put me through.
I am getting to the stage were I am thinking perhaps the financial advice I was given was wrong! am I right to be so stubborn?

You were advised wrongly. That does not constitute full and final settlement.
Lloyds rarely take court action and I do not think it is your best option to push for it.
LTSB is a complex organisation where the component parts do not talk to each other. It's as frustrating for those working within it as it is for those of us trying to negotiate with it.
The CABs do have a contact person who is reasonably helpful. My suggestion is that you find a CAB with a debt specialist who can access this person (his contact details are on CABLINK). He can look into the history of the account and hopefully try to reach a negotiated settlement, possibly a write-off.0 -
you have to make sure that lloyds accept the offer as full and final settlement before making the payment i'm afraid. How much is left owing?0

How could I get them to agree when I could not talk to anyone.
Plus what you are saying is that I was given bad financial advice by my debt management advisor0 -
Just to update you all
Lloyds are not persuing me any further with this and they are going to "write it off"
They did not have anything on there system to say that I had contacted them on numerous occasions and I had the phone records to prove that I did
