Wescot CCA

I wonder if anyone could gime me some advice? Recently i have had Wescot pestering me over a loan account which was passed onto them by the HFC.
I had missed a payment ages ago not realising until HFC had sent me a letter.
Anyway i paid them and my account was back upto date.
A few weeks later Wescot sent me a letter demanding £351, telling me that the HFC is demanding full payment of my loan account.
What bugs me is i have been paying the HFC every month without fail, yet Wescot keep bugging me for this debt.
I have wrote to the HFC about all this yet they have failed to respond to my letters. Since then i have wrote to Wescot asking for my CCA. A few letters later they managed to send me a signed CCA but the problem with the CCA is that the two signatures on the agreement which are meant to be mine are not identical.
Another thing is the CCA that they sent me is photocopied, and not the original one. Does it matter if they send me a photocopy? For all i know it could be a forgery?
Anyway i was wanting to know should i acknowledge that this is my CCA, and pay Wescot the £351 that i am meant to owe them?

    They are not obliged to send you the original. Do the dates and other details match with what you think should be on the agreement, such as date it was 'signed' by you and so on?

    What's the £351 for? is it for the missed payment or that and more?

    The dates and details match what is on the agreement, but its the signatures that look dodgy. Both of them are completely differnet. As for the £351 that is what is oustanding on the loan. I only pay £15 per month in instalments.

    Just to be clear are the loan payments of £15 per month the ones contracted as part of the agreement,ie you're not making reduced payments as part of a debt management plan or IVA?

    How long ago was this missed payment and how soon after did you bring it back up to date? When did you take out the loan? was it before April 2007?

    Agreements taken out after Apr 07 do not require your sig but if you took it out before this and you believe the signature(s) aren't yours then you could respond by telling them exactly that. Did you sign the lettrs you've sent to Wescot? By any chance do you think these on the CCA match any on those letters?

    It might be worth a quid to send a CCA request to HFC itself and see what they come up with. Send the letter to their head office and of course send it recorded.

    If you do this I think you'll get a response as they have to comply with the law but as you've said they are very bad at replying to anything they don't have to. Did you send any letters to them recorded?

    For such a low amount they will not take you to court . I would ring HFC not wescot. Ask them whats going on , could be they sold debt to wescot , but they should of given you notice of it .

    think thats bad - my OH got a letter from Wescot on friday for £25.31 for an account (which had been paid) from 2years ago for scottishgas.

    tried to call scottishgas waited for 35mins on hold and still didnt get through to anyone - ridiculous.

    this bill was paid, but cant find any the details. guess we're humped to pay it - its only £25 but it was a threatening letter (our first ever might i add)

    these people (debet collect"ards") and property factors ("management specialists") need sorted out - both are total ignorant to regular joe's and provide a bad, over expensive service (eg, my common rear door has been broken for 10month - i've contacted them about it and they are supposed to have 3monthly inspections but as yet its not been picked up.. they are charging us for something they dont do but is in their contract? - is this legal? - i mean i know if i complain and they start to do the inspections then the cost will go up so we're payign double for what we're supposed to already have?)

    sooner we have my own palce with no factor the better.

    i heard OFSTED(?) were doing an investigation into factors - any idea if i could voice my concerns somewhere?
