Hi folks,
Would really appreciate some advice.
I currently own a property, my parents live there as tennants (although they haven't paid me any rent for 6 months and are currently living there rent free!!!).
I want them to leave so I can sell the property and buy something else. I am in the process of taking them to court to evict them, however they have issued a counter claim against me and are asking the court to:
1. issue an order that I transfer the legal estate in equal shares
2. issue an order that I sign a declaration to hold the property on trust for my parents absolutely.
The mortgage, title deeds are all in my name.
Is it legally possible for obtain the above?
Thanks.

OMG these are your PARENTS!!!!, sorry I don't know your situation but I find it hard to comprehend how anyone could take their own parents to court to make them homelessAug GC £63.23/£200, Total Savings £00

Go and see a solictor who deals with property law
It will cost you!
Cant you come to some agreement with mum and dad ?0 -
on a first read it sounds as if the house belonged to the parents....they put the house in sons name (for whatever reason) now he wants/needs to sell it...and in the absence of what appears to be some sort of formal arrangement or properly drawn up paperwork (by a solicitor)there are now problems...
alternately with only 2 posts in different threads (both the same) it could be a spoof...wind up etcI'm now a retired teacher... hooray ...:j
Those who can do, those who can't, come to me for lessons:cool:0 -
One of the best achievements in the your life is to watch your child grow up and make you proud...................
Well, one out of two isn't bad.0 -

THis is what i posted on his other thread about the same thing
I don't get this......putting aside they are his parents....how can someone renting decide to do this?? Surely every (EVIL)tenant would just do it?
Could they only do this if they signed the house over to their son (on the understanding they stay there) to beat inheritance tax etc etc but now the son has decided to kick them out.
I'm assuming!!! which is the mother of all f*ck ups BUT its just how my brain works sometimes...so be gentle with meIf you find yourself in a fair fight, then you have failed to plan properly
I've only ever been wrong once! and that was when I thought I was wrong but I was right0 -
Best bet is to firebomb the place, followed up by beating up both your parents. That should do it.
