Lloyds say they don't have to provide my CCA

Is this rights.

Yesterday I posted that lloyds had sent me a copy of my T&C instead of a true copy of my signed CCA. I replied to them with a letter from here pointing out that what they had sent was not my CCA. Well after weeks they finally replied.

They say that the regulations do not requires us to send you a photocopy of the form which was signed. If the terms and conditions of the account have been varied since the agreement was made with us, we have supplied you with a copy of the terms varied. They go on about section 189(1) and 180.

Can any one advise further. Surley if they are threatning me with court action I am allowed to have my paperwork.

  • I am no expert but I would imagine they are wrong, the law states that they have to prove you owe the debt, that can only be proved by them issuing a copy of the CCA you signed, not just a sheet of terms and conditions, I think this only applies to credit taken out before 2007 though, but I am not 100%b sure

    Was this a bank account or a loan or CC? And when was it taken out?

  • Thanks milliemonster. This card was taken out approx 200/2001 was not a lloyds credit card at the time was an easymoney card bought over by lloyds a few years later.

    I didn't think they could refuse to send one out I am soo angry with lloyds.

    Fermi thanks for this will fire this letter off to them monday recorded delivery. I did try to google section 189(1) but could not make head nor tail of it.

    Its unbeleivable a company will actually put in writing that they do not need to supply a signed copy of a CCA especially if they are required by law do they just hope that I will go away and take their word for it.

    It's probably because they don't have it if they originally took on the debt when they bought out 'easymoney', they're just hoping you don't know your rights and will start paying it!

  • Thanks ifonlyitwaseasier I would have forgotten and woud have signed the letter.

    Milliemonster will update when i get a reply but knowing lloyds that will be some time away they don't adhere to time limits.
