Change in number of nights...

OH pays maintenance for 2 kids. We currently have them 3 nights a week and this is taken into account.

However, they have commented that they want to stay with us more.

If we change this and have them 4 nights a week - does that mean OH still has to pay maintenance until he claims the child benefit? Can it be reassessed and payments stopped without claiming the cb?

What happens if he doesn't ever claim child benefit? Does he have to continue paying csa with a 4/7 th's taken off?

Is csa only stopped when the other parent gets the child benefit?
Can you only claim csa against the other when you have the cb? :confused:

    If you have the children 4/7 then technically you are the main carer so therefore the CB claim should be transferred over to your husband's name and he can then make a claim for CSA from his ex.

    Can you not come to some kid of private arrangement and close the case down with CSA?

    Your OH EX will not allow the kids to stay 4 nights a week she has far too much to lose.
    maintenance, working tax credit( 16+ hours a week ) If she works ! child tax credit, child benefit and the fact that she would have to pay CSA to you.
    Not going to happen unless the kids want to leave mum.

    So I doubt it very much. In any case as soon as there was a disagreement, she'd try and contact csa again.
