Threatened AUTHORISED Visit by Debt Investigation Officer!!! For £26.76

I'm not sure if I am posting this in the right place as I have nevr used forums!!
Anyway my problem is all about £26.76 !!!!!

Years ago, approximately 5 , I ordered a phone and sent it back...but they are saying I owe the amount above which i sent them a letter at the time to tell them they were wrong and the item got sent back...

They have asked me for proof of return, it was years ago i dont have the proof anymore!!!

After a few threatening letters they have now said they have been granted to proceed with a personal visitation by a debt investigation officer!!!

I am fuming, I would of paid it if i owed it but i do not, its the principal of the matter.. i always pay everything on time, my credit history is immaculate apart from this one thing... I know this seems silly as people have far more value of outstandimng debts to worry about than this but it still bothers me that they are sending someone round...

People have said to me to just pay it, but then thats like saying that they are right and i do owe it... i refuse to pay for something that I never had in the first place!!!

What would you do? Any advice or comments appreciated!
Thanks:rolleyes:

What about the company you bought it from? Have you tried calling them up? Sometimes things like this can be resolved pretty easily.

  • Hi there

As far as I know this means naff all
granted to proceed with a personal visitation by a debt investigation officer!!!

As far as I can see the person they are sending round is just an employee of theirs that will come and try to hassle you into paying. You could send them a letter stating that you do not acknowledge the debt that they are claiming you owe.

They need to prove that you owe the money.

Check out the www.nationaldebtline.co.uk website for template letters to dispute the debt that they are saying that you owe.

If (and it's probably only an 'if') they bother to send anyone, you can rightfully tell them where to go. They have absolutely no powers or authority to make or ask you to pay them a penny. The only people who have this are court bailiffs and there has to be a CCJ in place. They are trying bully boy tactics and you can tell them to leave.

If it's over 6 years since any contact (or 5 in Scotland) it's probably statute barred so they can't take it to court.

Failing that, look up the letter asking for a CCA as without one they can't take the matter to court - which they full well know.

  • .... it has taken me ages to work out how to find my posted thread again...sorry!!! Not used to forums!!!

Yes I think from what you have said and what I have read if they do send someone to my door I just need to be firm with them and under no circumstances let them in... its rdiculous for the the amount that it is.... like i say i would just pay it but its principal... I guess I could try phoning the company but my phone costs me 50p a minute to call from and I really do not want high phone bills!!
Stuff them... my partner says no magistrate or judge in their right mind would take this to court for such a small amount of money, it would cost far too much!!
So i shall just have to await the dreded knock on the door and take it from there... Thanks everyone xxx
