CCA request help, and a couple of other issues. Help please.
Ok, background;
My partner (I wasnt with him at the time) has had three loans from RBS to clear his overdraft. These started in 2004.
The first one was for £1800, and the repayments were £100 a month.
This left him with £57 a week left over after mortgage, bills, food for him and his partner, and son.
A few months later, he got a second loan from RBS to clear his overdraft again. This one was for £1801.
Repayments were £117 a month.
After bills, mortgages and repayments, he was left with £34.90 a week for him, partner and son.
A few months later, he got another loan off RBS for £1396 to clear his overdraft AGAIN!
Repayments were £160 a month.
After bills and mortgage, he was left with MINUS £24.71 a month for TWO children, and two adults.
All these loans were made in the local branch.
Firstly, is this irresponsible lending? As shouldnt they have checked that he could afford the repayments? They only had to check his bank statements to see that he couldnt.
His partner was clocking up debt on catalogues all over the place, would his credit record have shown this? Should they have checked it?
Also, before the third loan, OTHER items were being unpaid, doesnt this show he couldnt afford the third loan?
The second loan was going into arrears, should they have given a third?
We are currently claiming back PPI for this loan. And we just about have got our bank charges back due to financial hardship, and that has been quite a feat! We are at risk of losing our house because of these debts, we just cant pay them.
Would it be worth making a CCA request for all three loans? They total £5,000.
We also have one with RBS for £7000.
Would a CCA request be worth it here too?
Iv had a CC with Capital One since 2005. I got it over the internet. Can I make a CCA request. Did the law change regarding online credit?
Iv had an Asda CC for about 8 months, its at £2200, I got this over the internet too. Can I make CCA request?
What about catalogue bills over the internet?
Also re the loans. After the second time he went £1800 overdrawn, and had to get a third loan, shouldnt they have cancelled his overdraft when he'd got the third loan?
He never activally went seeking the loans, they pestered him to get them when they saw he was constantly going overdrawn.
He only earned £190 a week, and when they granted the third loan, he was only on £90 a week!!!
Sorry its so long, we have SO many letters going to the bank, and Im doing it all by myself, Im getting mixed up and ever so stressed.
