Moving jobs

I’ve been working for my company for a number of years and recently applied for an internal job. I got the job and accepted it in the middle of September. So I assumed as my contract states I would have to serve my one month notice and then could move into my new role (in the same dept). My current manager and my new manager and HR then decide because I am the only person who does my role that I cannot start my my new job until 1st Dec. So about 9 weeks away.
I complained about this and have been fobbed off a few times now. I don’t want to start off my new role on a bad vibe but I applied for a new job because I was so unhappy in my previous one. HR were aware of this but still I’m being made to work a lot longer in my old job.
I even offered to do two jobs for a month but they would not let me do that despite 4 colleagues in the office already doing this due to staff changes.
Does anyone know if there is a law which means that the company must honour my one month notice? I’m really frustrated and it’s totally taken away the excitement of starting a new job.

You said you didnt want to start your new job on a bad vibe, but thats exactly what you will do if you start spounting laws at them.
Just suck it up and get on with it.make the most of it, we are only here for the weekend.

I'm not sure of the legalities, but I think that your one month's notice is only applicable if you resign from the company that employs you. Where you are effectively transferring to a different role within the company, I think that they can argue that for operational efficiency, it makes more sense for you to start your new employment on a certain date - it may be that your old manager and new manager have negotiated something that suits both. The fact that 4 of your colleagues are doing 2 jobs already may be the reason why you can't - it just may not be practica.
I would ask though, if you are unhappy in your current job, is moving to a new job in the same department going to be so different?
Hope it all works out for you - it may be worth hanging in there til December 1st if the new job is exactly what you want.0 -
Thanks Jonathan, that's very helpful. I'm moving from an admin role into a sales role so the bonuses are very different and I'd be working with different people so it would be much better. There are many reasons why I want to move one of them being a colleague who can be quite rude. Over the last year I have been working with HR to address my unhappiness but none of that has been taken into account when moving me into my new role.
I'd just thought I'd ask to see if anyone knew. Looks like I'm stuck here.0 -
Just to reinforce, I'm certainly not an HR specialist, but I'm fairly certain you will probably have to run with the date they propose. The company obviously feels that you will be able to do the sales job they've offered you, and you've clearly got it on merit, rather than because of your unhappiness in your current job - good for you! Hope it goes well, and don't forget, 1st December will be here before you know it, and shortly after that, so will Xmas - what a scary prospect. You also now have an escape route from your other colleague - keep focused on the positives and the time will fly by.

I would have to agree with Jonathan, I think internal job transfers opperate under a different set of rules, and the 1 month notice would apply only should the OP choose to leave the company.

just shorter and to the point. I didnt realise you were going to pick it as
