Application Fee Non Refundable?

We explained to our mortgage broker that we were in probationary periods and were completely honest with our financial situation from the off.

The broker found us a mortgage with the C&G, he made them fully aware of our situation and we were credit scored and offered an 'agreement in principle'.

Prior to paying the application fee of £99 our broker assured us that he doesn't like to put mortgages through unless he knows they are a safe bet.

We took his advice and paid the application fee. Two weeks later I had to ring our broker only to find we had been declined due to our credit score!! Despite already being credit checked our broker now decides to tell us that we were a borderline case and C&G have changed their scoring criteria.

As a result we are £99 out of pocket and are still waiting for our £260 survey fee to be refunded.

Our Broker says we cannot speak to C&G directly and must go through him with any complaints we have.

Do we have grounds to complain either about the broker or the C&G?

Any help would greatly be appreciated.

    I did warn about C&G doing this here

    Not really

    They have changed their criteria and there is not much you or the broker can do about that

    I had a long argument with C&G and the BDM saying how could a good case be accepted one week, and then the same good case be declined a few weeks later. No changes in customer details or credit history.

    They shrugged their shoulders - so if C&G do not want good clients, there are other lenders that do, and they will not be messing my clients around for a long while (unless they are the only option!). And I will make a point of telling my clients that this is the case before they proceed with C&G.

    If this happened to one of my clients (it wouldnt have, as I wouldnt have used C&G in the first place) then as a gesture of goodwill I would refund £99 out of the commission from another lender.

    Thats just me though.
