HSBC - Can they do this?

I have a loan with HSBC, I missed a couple of payments over the Summer as I am self employed and things were quiet. I made some part payments and the full amount this month. I've wrote to HSBC explaining the problem and offering a repayment plan but they have never replied. They ring day & night, but I've stopped answering the phone as whenever I do speak to somebody they just ignore my explanation and insist I must pay the arrears, or offer a 14 year loan at 7% over base. I know I'm pathetic but on the 4 occasions I have tried to sort it, I get so frustrated I just end up crying.
I banked a cheque on Friday into a different HSBC account and they have just taken the money from that account toward the loan today. The cheque will not even clear until Tuesday.
Can they do this? I know banks don't give a damn (polite!) about us but the money was for my mortgage, so will cause me real difficulty now.
Has anybody come across this before?

    I'm unsure if they can do this or not, but you need to write to their head office, explaining what your circumstances were, and what they are now, and tell them that money was for your mortgage. Don't be bolshy in the letter, and I guess they're not obliged to respond favourably, but courtesy and writing to them may help.

    Yes they can, it's called right of recovery, a bank can take any money in any account with them if you owe them money. It's why if you're having problems it's recommended you open a new account away from your creditors. I agree with Airwolf though, try writing to them again.
