provident problem
Hello this is my first ever post, i am looking for some advice regarding a provident loan i recently had (yes i know they have very high apr). I had a loan previous and always paid up on time, so when i finally paid off the balance i decided to get another loan for £600.
The agent called to my home and the first thing i asked was "what are the terms?" the paperwork said 56 weeks @ £12 per week, i thought ok i can afford that and i took out the loan. Anyway the agent called today and as always i leave her a cheque in my shed for her to collect because i aint at home the time she calls. So i was very suprised to recieve a text message from the doorstep agent saying "you are £6 short the payment should have been £18" i immediatly text her back saying according to the paperwork it says £12 per week, she then replied "oh i must have made a mistake filling in the forms but the payments will be £18".
My question is what can i do regarding payments? i would not have taken out the loan for £600 if i knew i had to pay £18, £12 is probobly my limit, as i said before the credit agreement written out by the agent say's £12 per week, is that legally binding? can i refuse to pay £18 per week? I dont really want to get the agent into trouble as she is a lovely person, but this had put me in an awkward situation. Any advice would be appreciated.
Thanks in advance

In 2004, I took out a personal loan with Provident, but when I moved for personal reasons, i didn't make my payments. Then in June 2006, I had a knock on my door from an agent for Moorcroft Debt Recovery. I argued with this guy that they should have wrote to me, to which he said they didnt have my address, so I was curious as to how he had found it, as very limited people knew where I had moved to. He demanded I came to a payment arrangement, which i did, of £50 per month. I have 2 small children, so after the second month I dropped my payment to £30 per month.

Is the paperwork thatyou signed also been signed by the provident agent?
I would double check everything on the agreement - down to manually calculating the total amount repayable to check that.
I would then write to the provident head office - they will have a complaints department including a copy of the agreement that you have.
as the collector receives a commission for how much she collects in she has a vested interest in you paying the £18pw and will not agree to lower even though she has messed up. Your only solution is to take it to a higher level. I would also go to your local CAB.0 -

The agent and office are at fault for not checking the paperwork properly.
Is the office near where you live?
If yes, I would take the paperwork to the office and see what they say.
If not, contact Head Office in Bradford.
You can call us on 0800 409 6654.
We are available Monday to Friday 8am - 8pm and Saturday 8.30am - 5pm.
Hope you get a good answer.0 -

Whilst this is true that the agent receives commission, she cannot lower the level of the loan as she has no authority to do so.

Would assume that Provident will have to accept the £12 pw if thats what your signed agreement says.

yes i have 2 sheets of paper, one yellow credit agreement and one white pre contract information both saying £12 per week over 56 weeks and both signed by me and the agent. I dont reckon they have a leg to stand on over this, but will visit my local CAB on monday to make doubly sure. thanks for your help.
Hi mrdrunk
Tell your agent to send her manager out. Take photo copies of your agreement and keep the original safe. You will only have to pay the 56 x £12 and they will have to write off the other £320. She has quoted you the repayments for a £400 loan.
