Just discovered my name on bankrupt register & didn't know I was bankrupt!

I hope someone can help. I have been saving up for ages to apply for bankruptcy and I have just checked the register to find that I have already been made bankrupt a couple of months ago.

I don't know who has made me bankrupt (I have moved house a couple of times so I guess they sent letters but I didn't get them) and what I should do next.

It says my automatic discharge date will be 1 year from the date the order was made.

I am really scared now. Am I in trouble? Who do I contact? Does this mean that all debts prior to this have automatically been written off?

Please help. I am so worried.

    On the site under your name it should give deatils of the OR who is dealing with your case and a phone number. Ring them first thing mon morn and explain.Yes all debts up to that date are included,i think.lol
    Calm down and take a deep breath. The only ones that we know to that do actually you make you bc are council tax and HMRC did you owe to either of those?.Dx

  • Thank you for that. I had an IVA (typical story of being misold and couldn't keep up repayments) so I have a feeling it was them.

    My main concern is that I was in a terrible relationship and all my previous paper work was destroyed by my ex partner and he admitted that he has been opening my post too. Nice chap eh? (Informed the police a while back). What this means is that I haven't got a clue who I owe to. Know some but not all. Does that mean if I don't tell all companies they can still chase me for money in years to come?

    I have also changed back to my maiden name. How will this affect things? Sorry for so many questions...breathing deeply :D but still worried

    Do you have any assets you stand to lose? What were you trying to protect by going for an IVA? If nothing, then all that's happened is they've just saved you £495 in fees.
  • Thank you once again. I don't have any assets at all. I was a couple of years into my IVA and self employed but wasn't earning enough money. My ex partner left me with lots of debts and I ended up in a homeless hostel (with my child) for a few months. I managed to get a full time job which is going really well and now I have a small rented flat. I feel for the first time in my life I have a future. It's weird, although I have nothing I have really started to rebuild my life and going bankrupt was my way of completely starting afresh. It took me months to save up for the fee otherwise I would have done it last Feb. I checked out the London Gazette and apparently they petitioned me in April!!!!

    Will I get into any trouble because I didn't know anything about it. Obviously I hid from my debts (and rotten ex partner) or will they take this into account?

    As I have no assets (except an old banger of a car £400 which I need to get to work) and am a single mum getting herself straight money wise will this give me a chance of getting an early discharge?

    I told my employers, by the way and they have been fantastic and admired my honesty!!!

    If it was done in April, you're already half way through. I'd take the advice above and phone them Monday morning to see if you need to do anything.

    You may need to get an income and expenditure ready (not before the phone call though). Just explain to them as you have here that you got out of your relationship and were living in a hostel etc. Don't worry, the things most people fret about are making the decision to go BR and the lead up to it. I'd say you've had a painless ride so far!

  • Nothing to add but Hi and welcome and WOW bet that was a shock!!!! But it will probably work out for the best if you had no assetts!!!

    Dont worry about the paperwork, the OR will be able to get that, If your ex was doing what you said and you have had the police involved the OR will be ok with that. Just be truthful with them and everything will be ok.

  • Hi again. They petitioned me in April but I was made BR in August. Do they take into account April? It says my automatic discharge is Aug '09
  • No they run from Aug 08 to Aug 09 you may get Early Discharge but nothings guaranteed. Another positive is it saved you 500quid!!!
