Missing fathers and no maintenance

My girlfriend has two girls, aged 5 and 8, from previous relationships (both separate dads) and a little boy aged 3 from her ex husband, who has special needs and who she gets DLA for.

The only maintenance she gets has been in the last two years from the dad of her youngest daughter who was absent for the first 3 years of her life. The man refuses to get a job and is happy to permenantly scrounge JSA dole. He pays her in two seperate ways; firstly he pays £6 a month through the CSA plus another supposed sum of £15 a week which they agreed at court when he eventually applied for access two years ago.

However he very rarely pays the full amount of £15 and most weeks she is lucky to get half if anything. Nor did she receive and kind of payments from him during the first 3 years of the childs life when he went missing. She's complained to the court about him not coughing up the agreed amount but they were simply not interested.

She's so far also been unable to get any money whatsoever for either of her other two kids. She's rang the CSA but was told that they couldn't do anything for her as both the two father are missing and she doesn't have an address or NI number for either of them - despite one of them being her former husband the CSA say they have no way to track either of them down.

The closest she came to getting any money out of her ex husband was in late 2005 when a friend informed her of an address he was living at. She promptly passed the info onto the CSA but they dragged their feet in doing anything about it. She repeatedly chased them up only to be told that they'd written to him but he'd not replied. That persisted for 12 months until eventually the CSA sent her a letter saying he'd moved away and his whereabouts were once again unknown.

Is there anything she could do to get any money for the kids that belong to the two missing fathers or any way she could ensure that the dad of the youngest girl pays her the full amount that they previously agreed on at court? If not is there any way that she could make him pay back pay for the first 3 years that he missed?

    Courts and CSA are in no way related, so if CSA assessed dad no.3 to pay at £5.00 a week, thats all he has to pay. (He must also be paying £1 arrears to make the payments £6.

    The minimum info the CSA need to try and trace someone is a name and date of birth plus an idea of the area they live. They can search, and hopefully only one match will come up and they'll have the national insurance number to search further through inland revenue or benefits agency.

    However, if all the PWC can tell the CSA is that his name was John Smith and his birthday was in June, an awful lot of matches will come up and it'd be impossible to narrow it down.

    How totally inappropriate is this comment? :confused: Regardless of what you think, every child has a right to be loved and supported by both parents, no matter what the circumstances. If you don't have anything nice or constructive to say, say nothing. These two little girls are not objects, they are real little people who need looking after, feeding, clothing etc etc and they are the innocent party. I see you are new on this forum - and whilst this comment is your opinion, a little compassion regarding innocent children wouldn't go amiss:rolleyes:

  • it is not my fault that people dont like the facts. maybe she should have chosen who she had kids with better these kids only have a few years inbetween them which just goes to show she was immature herself or didnt have education of contreceptives. she should take them on jeremy kyle love that show i do, he will tell it to her straight
  • ok so she has been unlucky with her choices in men but that doesnt mean her children werent planned!

    'the facts' are she has 3 children to bring up and her partner is seeing if we can help them find a way to claim maintainance for them, not for people to judge how she got to where she is now.

    remember it takes two to tango and if these blokes didnt want to provide for children then they shouldve used contraception themselves!!

    sorry i cant help with the original question but hope you can get enough details to track them down.

    Although with all the knowledge of CSA, you will at least be prepared when your own claim gets filed...

    I am hoping she knows their full names?
    She can help her self by doing some detective work herself, doing a search usually throws up a myspace or facebook page?

    Look at their info, may say what they do for employment?

    As for not knowing her ex husbands NI number, was it not listed on a old tax credit form or payment schedual? We seem to get 10 through each year.
