Nhs Pension Transfer

some of you may already know bits about me.....going thro a nasty money-grabbing divorce at the moment. Well, I'm trying to get what is fair for me and the kids, he's trying to keep the lot!!

I now know about his NHS pension - I have been given the transfer value of it.

Has anyone here any experience of this - either working with it or going thro it themselves? please?

i'm just off to read my divore book to get a few clues on it all, but would like help from everyone here too please cos you're the best...easier to understand when it's explained to me in oridnary language!

  • You are entitled to a share of the transfer value of his NHS pension. Assuming that all the other assets are sorted, then you are entitled to the same share of his NHS pension - so if you've agreed on 50/50 then you should get 50% of his NHS pension. There are regulations for Pension Sharing on Divorce.

    You will almost certainly be required to pay this amount into your own private pension - or to set one up, if you don't have one. Otherwise, you could agree to forego a share of his pension if he gives you other assets to the same amount. Let's say his NHS pension transfer value is £50k. So, you would get £25k (assuming 50/50 split) paid into your own pension plan. Otherwise, he gives you £25k of other assets e.g. share of house and you leave his pension alone.

    It really is that simple.

    Are you not using a solicitor? He should have declared his pension the Form E!

  • thankyou...yes I am using a solicitor but want to completely understand it all before I see her next....want to save money, cos up until now I have left it all to her. Yes he should have put all this in his form E which is why the court said he has to answer 49 questions relating to his finances. He has made us waste so much money by thinking he can do things his own way, by not disclosing information. I am now sitting here reading thro a four-inch file of the answers to these 49 questions.
