Any Advice?

I had borrowed money from a company called flex investment 5 years ago for 34000 to use as a deposait for a property which they sold themselves, they then put a secured that money on the property, we have been paying 250 a month for the past 5 years so far, but it has just come to my attention, that we dont have a contract!!!!!!!, I and my wife do not remember signing anything!
Now flex investment have gone into administration and another company called marlin (debt collectors) have control, I asked them to forward a copy of my contract as I do not remember signing one, and they sent me a letter saying that they are unable to provide us with one and that we should have recieved this when we signed the morgtage agreement, but our mortgage is with another company(LMC) and the 34000 is with flex.
Can i take them to court to have them remove the caution and not pay them anything anymore as there is not contract?
A friend told me that if I take it to court the first thing they want is a copy of the contract, if that does not exist, does that mean I am right?
