IPA -Advice needed

Hi all , Just want some advice for another familly member , they went bankrupt before me and were discharged in june they had an IPA imposed but when they moved out of their parents house they wrote to the OR and explained they couldn't afford ipa any longer due to increased living costs so this has been accepted by the OR , they have since been discharged and then got a new job where they are earning substantially more so therefore could afford to pay again do they have to inform OR now even though they are discharged , I think they probably won't as they are enjoying the extra cash but could he get caught and found out. I don't know how this works as I didn't get an IPA as I don't earn enough as on maternity leave so any adice greatly received.

    Yes they must inform the OR within 21 days of any change in income. They signed a legal form to say they would do this so are legally bound by law to. Don't forget the IS and the HMRC are friends.

    Also if there living circumstances have changed then it won't be the same amount any way, it will be sorted to suit thier current circumstances. Tell him to come on here and we will help him with his SOA and make sure he has remember every thing :D. Tell him we are a lovely bunch and don't bite :D

  • Thanks ,when he moved put he let them know he had moved out and filled in a soa again showing he could no longer afford IPA this was just before discharge , though now he can as he has got a new job not long after discharge in june I would point him in this direction if I thought he would listen just scared he will get into trouble

    He may be lucky and slip through the net but he will be looking over his shoulder all the time waiting for the axe to fall. When he went BR he left all that behind with the creditors, so why start again. With the rise in living expenses etc there is a chance he may not get one or at least maybe a minimal one of £50 a month. If he is found out then he could have his discharge suspended while they go through his financial matter with a fine tooth comb. He is legally bound to tell the OR.

  • thanks TF ,he thinks as he has been discharged there is nothing the OR can do now , he has more than enough surplus as he has just bought himself a motorbike and brand new leathers and helmets for him and his OH makes me quite angry really when there are people who are struggling :mad:

    Well I hope it doesn't come back and bite him in the bum big time. It looks as if he hasn't really learnt his lesson at all.

    Can you talk to his OH at all and tell her what could happen.

    If he had an IPA before discharge then it will have been suspended,unless like me it got dissolved. They would need to check the wording on any letters the OR sent regarding his IPA.The OR has many ways of checking up,with the tax man for instance;) .If he is found out then he stands to get into serious trouble.Dx
