mackenzie hall

hi I'm new on here but I'm so mad re this company mackenzie hall,

i had a debt 4years ago with jd williams, which i paid back, Then 2 years later Mackenzie hall contacted me saying they had bought the debt & i owed £400 i explained the debt was paid back but they said they wanted proof! (but after 2 years i didn't have proof) so i had to pay or they would take me to court as it was up to me to prove it was paid, we verbally agreed to pay £15 a month for 27 months which i have paid by standing order every month this was paid up on 26/08/08. in December 07 i got a call saying i had defaulted in September 07 i hadn't & had a bank statement to prove it the bloke on the phone said don't worry it was the computer they had changed over to. however i still got letters saying i had defaulted i contacted my bank & they said i had never defaulted, then 8/10/08 i got a call saying i had defaulted again that i still owed them money i explained the sum of £405.88 had been paid & the standing order was automatically stopped by the bank after 27 payments at this point the woman got abusive shouting down the phone for me to stop shouting which i wasn't & that if i didn't pay she would ruin my credit rating at this point i hung up on her,then she called back demanding to speak to me my husband told her she would have to speak to him at this point she became abusive to my husband &hung up on him.

i have contacted my bank again & they have checked how much i have paid this company & when they are sending proof of this to me.

but today this woman has called again leaving a message for me to contact them urgently. any surgestions please.

    First of all never deal with these people on the phone they are bullies and will make all kinds of threats to make you pay up. You say they said you owed £400 to them and you have now paid them £405.88 so cancel your direct debit get confirmation from your bank of how much you have paid to them and then write them a polite letter telling them to go get stuffed.

    I think you need to get some legal advice on this one. I think you are going to have to take them to court and get your money back.

    You can get your bank statements from four years ago which will show payments made to jd williams that you made out of your bank account.

    I think you need to send an SAR to jd williams as well to prove that you paid them. An SAR to mackenzie hall will show what you have paid them as well.

    Write to them telling them that the telephone calls amount to harassment and that you will only deal with them in writing in future.

    Can I ask did you start paying them without them proving the debt ? It just amazes me how people fall for this kind of thing . Did you receive any communication from the Original company saying alleged debt had been assigned to them ? Did you just take their word for it ? It is not for you to prove you paid it , its for them to prove you did not ! Even a simple CC request would have been enough to stop them in their tracks .
    The best thing you can do now it do a SAR costing £10 this will show all details they hold on the alledged debt . Did you not write to the OC , when this DCA first got in touch ?

    It is always the responsibility of the DCa to prove that you owe the money, not your responsibility to prove otherwise.

    Please do not ring them.
