If the house id yours then it is not a joint expense and should come out of your wages I would have thought so should not be on OH 's SOA. Though if I am wrong I am sure others will comment.BSCno.87The only stupid question is an unasked oneLoving life as a Kernow Hippy0

I'm a bit confused about that to be honest, as I've had conflicting advice and I'm not sure what to do with it. My feeling is that we should declare the house so the OR knows we're being totally up front and not trying to hide it from him. It's definitely in negative equity, so he'll probably have no interest in it so long as I buy OH's BI, which CCCS say I will need to do. Can I do that without it being on the SOA in the first place? If so then I can take it off the SOA, which would make it look simpler!

Another question (sorry about this!)
As the mortgage on our house and the rent on where we're living are both in my name only, should either of them be on OH's SOA?
If I took them off, would the OR want to know what OH is doing with his mortgage / rent? And where he's living!!

Thanks Shadow - really helpful again. I was thinking that wouldn't be very fair, especially as OH's income is so low at present.
Another question that's scaring me a bit - will the OR (or the judge) want to know my exact income and expenses as well, or just my contribution to household? Cos at the mo I'm paying for nearly everything, but we'd like to get that more to 50/50 asap, hopefully without getting an IPA. Is that realistic, or will the OR expect any extra earnings of OH's to be counted as surplus?
You all really are so helpful - I've gone from panic attacks and IBS symptoms to feeling quite upbeat over the past few days! I know it wont be easy (esp for OH, who's having lots of extra hugs at the mo) but we are both so looking forward to being able to look forward!! :j

Your OH's bc is just, that HIS BC,not yours. I mean that in the nicest way. The OR looks at that way too. If at the moment you are paying for everything so be it. When at a later date your OH gets work and contributes then the % you contribute will alter.
No the judge nor the OR will want to know your exact income or expenditure. The OR may ask for rough figures but that is all.
What will happen is that as it stands now your contribution will be greater as OH's income is either low or non existent. When he gets work then your contribution will be lowered to conteract that. I have filled in 6 I&E in 10 mths and only 2 were the same. I am not saying you don't declare it on the forms. I just feel it makes your DH's SOA more complicated than it should be. But as I said I am not positive on that. Might be worth asking CCCS.

Tiger, I know exactly what you're getting at - I do need to clarify with CCCS as I'm not sure what's right. CCCS and Insolvency Line said different things yesterday, and I've had so many things to ask I forgot to clear it up.
